Terms Used In Tennessee Code 29-6-128

  • Attachment: A procedure by which a person's property is seized to pay judgments levied by the court.
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Plaintiff: The person who files the complaint in a civil lawsuit.
  • Property: includes both personal and real property. See Tennessee Code 1-3-105
  • Writ: A formal written command, issued from the court, requiring the performance of a specific act.

The writ of attachment should direct so much of the property of the defendant to be attached as will be sufficient to satisfy the plaintiff‘s debt or demand, and all costs.
