(a) The holder of a nonprofit entity temporary event permit may auction alcoholic beverages, for consumption off premises, to raise money to support the stated purpose of the permit holder.
(b) The proceeds from an auction authorized by this section shall be deposited to the account of the holder of a nonprofit entity temporary event permit.
Terms Used In Texas Alcoholic Beverage Code 30.06
- Commission: means the Texas Alcoholic Beverage Commission. See Texas Alcoholic Beverage Code 1.04
- Distilled spirits: means alcohol, spirits of wine, whiskey, rum, brandy, gin, or any liquor produced in whole or in part by the process of distillation, including all dilutions or mixtures of them, and includes spirit coolers that may have an alcoholic content as low as four percent alcohol by volume and that contain plain, sparkling, or carbonated water and may also contain one or more natural or artificial blending or flavoring ingredients. - Person: means a natural person or association of natural persons, trustee, receiver, partnership, corporation, organization, or the manager, agent, servant, or employee of any of them. See Texas Alcoholic Beverage Code 1.04
- Premises: has the meaning given it in § 11. See Texas Alcoholic Beverage Code 1.04
(c) The holder of a nonprofit entity temporary event permit may not:
(1) auction distilled spirits or wine that has not been donated to the organization;
(2) auction alcoholic beverages if any taxes are owed on the beverages; or
(3) pay a commission or promotional allowance to a person to:
(A) arrange or conduct an auction under this section; or
(B) arrange the donation of alcoholic beverages to be auctioned by the organization.
