Terms Used In Texas Government Code 531.081

  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.

If any portion of Sections 531.078-531.080 is held invalid by a final order of a court that is not subject to appeal, or if the commission determines that the imposition of the quality assurance fee and the expenditure of the money collected as provided by those sections will not entitle this state to receive additional federal money under Medicaid, the commission shall:
(1) stop collection of the quality assurance fee; and
(2) not later than the 30th day after the date the collection of the quality assurance fee is stopped, return any money collected under § 531.078, but not spent under § 531.080, to the persons who paid the fees in proportion to the total amount paid by those persons.
