(a) The executive commissioner shall ensure that Section 1917(b)(1) of the Social Security Act (42 U.S.C. § 1396p(b)(1)) is implemented under Medicaid.
(b) The Medicaid account is an account in the general revenue fund. Any funds recovered by implementing the provisions of Section 1917(b)(1) of the Social Security Act (42 U.S.C. § 1396p(b)(1)) must be deposited in the Medicaid account. Money in the account may be appropriated only to fund long-term care, including community-based care and facility-based care.
