(a) The amount of an administrative penalty may not exceed $5,000 for each violation per day.
(b) The amount of the penalty shall be based on the schedule of sanctions adopted under § 801.411.
(c) A committee described by § 801.408(c) or (d) shall recommend the amount of the administrative penalty based on the schedule of sanctions adopted under § 801.411.
