(1) Subject to Subsection (2), grounds for the following division actions regarding a licensee are under Section 58-1-401:

- Division: means the Division of Professional Licensing created in Section
58-1-103 . See Utah Code 58-1-102 - Licensee: includes any holder of a license, certificate, registration, permit, student card, or apprentice card authorized under this title. See Utah Code 58-1-102
- Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
(1)(a) refusing to issue a license to an applicant;
(1)(b) refusing to renew the license of a licensee;
(1)(c) revoking, suspending, restricting, or placing on probation the license of a licensee;
(1)(d) issuing a public or private reprimand to a licensee; and
(1)(e) issuing a cease and desist order.
(2) The division may not refuse, revoke, suspend, or in any way restrict an applicant or licensee’s license under this chapter solely because the applicant or licensee seeks or participates in mental health or substance abuse treatment.
