Any licensee, permittee or certificate holder adversely affected by a decision of the board entered after a hearing may obtain judicial review of the decision in accordance with section four, article five, chapter twenty-nine-a of this code, and may appeal any ruling resulting from judicial review in accordance with article six, chapter twenty-nine-a of this code.

Terms Used In West Virginia Code 30-17-17

  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Board: means the State Board of Sanitarians. See West Virginia Code 30-17-3
  • Certificate holder: means a person holding a certification issued by the board. See West Virginia Code 30-17-3
  • Licensee: means a person holding a license issued by the board. See West Virginia Code 30-17-3
  • Permittee: means a person holding a permit issued by the board. See West Virginia Code 30-17-3
