Divorce Granted in New York to Lesbians Married in Massachusetts

In an unprecedented decision, NY Judge Rosalyn Richter is allowing a same-sex couple married in Massachusetts to divorce in their resident state of New York, writes the New York Law Journal. The judge cited Martinez v. County of Monroe and Beth R. v. Donna M. in her decision, both cases where courts in NY had recognized same-sex marriages performed in Canada. She also noted Governor David A. Paterson's instructions for state agencies to recognize the marriages performed in other states and stated that enforcing the unions relied on the full faith and credit provision of the state's Constitution.
