On 11 Sept 12, 2015 hrs, my 2009 Scion xB vehicle was involved in an accident, front end collision into rear end of a Nisson Extera. The vehicle owner has valid concerns of the functional status of the three systems (SRS airbag system - front, Traction Control System, and Front (both seats) restraint systems), I have contacted the Scion Corporate Headquarters. Case number is: 1209142182. Representative spoke with: Claton. Called on 14 Sep 12, 3:45 PM CST. Provide him all information about accident and my concerns. He (Claton) called me back on 17 Sept 12. He provided me an e-mail address to upload pictures of the front airbag sensors, but I am hesitant to send at that time. Had taken pictures of both the skid marks on road with measurements and of each airbag sensor mounted on the vertical brackets. The bend and distortion of each bracket may not be sufficient to trigger deployment of the front airbags; but I don't have the technical engineering information available to determine deceleration criteria. Based on the skid marks, it is apparent that the Traction Control System (brake anti-lock) was not functioning. Prior to the accident there was no service light(s) illuminated for either the SRS airbags or the Traction Control System; to include any other systems. Additionally, both occupants stated that at time of collision, they both were wearing seat belts and their lower body projected forward and upper body also projected forward and each of them had to brace themselves with their hands and arms to prevent from head striking the steering wheel and dash board. Neither of them shows any signs of soreness and/or bruising across the area where the seat belts covered their body. I am concerned into why each restraining system failed to perform as designed. If they have failed and were faulty, then they should be replaced. If evaluation reveals that they were functional, then they also should be replaced due to the system experience strains and stresses which decreased the life and effectiveness of the system components. If another event would happen to occur, they would not provide the seat occupant of 100% effectiveness.
I have been running into hurdles with Scion. Many calls to inquire status. Their response is that my case is with their legal department and will receive correspondence via US Mail. Would not give me telephone number to their legal department. I have been waiting for what I consider to be too long for Scion Corporate Headquarters to tell me what the status of my claim and what they will do. They told me not to continue accident damage repairs on my vehicle until I hear from their legal department.
All concerns and information have been stated. We feel that actual contact with the vehicle in front could have been avoided.
Scion did hire a third party to extract the vehicle computer data. History fault data revealed issues with all three systems.
Seeking assistance in getting resolution with this case. My expectations are to have the car fixed by Scion/Toyota; all defective systems at no cost to the owner. Vehicle accident damage is covered under my USAA insurance. Additionally, am seeking reimbursement for rental car fees; due to Scion stating no to continue repairs until they deemed so.
Thank you for your assistance. Please let me know if your agency requires additional information.
