Sec. 1. As used in this chapter, “owner” means a person that:
(2) is a tenant, lessee, or occupant of; or
(1) has a fee interest in;

- private property: means a property whose owner is a person other than the state of Indiana. See Indiana Code 34-30-19.5-2
(3) is otherwise legally in control of;
a private property that is adjacent to Lake Michigan.
