  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Plaintiff: The person who files the complaint in a civil lawsuit.
  • Trustee: A person or institution holding and administering property in trust.

A trustee or receiver, upon application by the trustee or receiver in the court in which any suit is pending, shall be substituted as party plaintiff in the place of the corporation in any suit or proceeding which was so pending at the time of the trustee’s or receiver’s appointment. No action against a trustee or receiver of a corporation shall abate by reason of the trustee’s or receiver’s death, but, upon suggestion of the facts on the record, shall be continued against the trustee’s or receiver’s successor or against the corporation in case no new trustee or receiver is appointed.
