Terms Used In Michigan Laws 764.21
- Arrest: Taking physical custody of a person by lawful authority.
- Federal law enforcement officer: means an officer or agent employed by a law enforcement agency of the United States government whose primary responsibility is enforcing laws of the United States. See Michigan Laws 761.1
- Felony: means a violation of a penal law of this state for which the offender, upon conviction, may be punished by imprisonment for more than 1 year or an offense expressly designated by law to be a felony. See Michigan Laws 761.1
- person: may extend and be applied to bodies politic and corporate, as well as to individuals. See Michigan Laws 8.3l
A private person, when making an arrest for a felony committed in his or her presence, or a peace officer or federal law enforcement officer, when making an arrest with a warrant or when making a felony arrest without a warrant as authorized by law, may break open an inner or outer door of a building in which the person to be arrested is located or is reasonably believed to be located if, after announcing his or her purpose, he or she is refused admittance.
