Subdivision 1.Scope.

For purposes of this chapter, the terms defined in this section have the meanings given.

Terms Used In Minnesota Statutes 638.011

  • Conviction: A judgement of guilt against a criminal defendant.
  • Impeachment: (1) The process of calling something into question, as in "impeaching the testimony of a witness." (2) The constitutional process whereby the House of Representatives may "impeach" (accuse of misconduct) high officers of the federal government for trial in the Senate.
  • state: extends to and includes the District of Columbia and the several territories. See Minnesota Statutes 645.44

“Board” means the Board of Pardons under section 638.01.

Subd. 3.Clemency.

Unless otherwise provided, “clemency” includes a pardon, commutation, and reprieve after conviction for a crime against the state except in cases of impeachment.

Subd. 4.Commission.

“Commission” means the Clemency Review Commission under section 638.09.

Subd. 5.Department.

“Department” means the Department of Corrections.

Subd. 6.Waiver request.

“Waiver request” means a request to waive a time restriction under sections 638.12, subdivisions 2 and 3, and 638.19, subdivision 1.
