Nebraska Statutes > Chapter 23 > § 23-1824 - Minor; autopsy required; when; guidelines; reimbursement

Current as of: 2010

(1) The county coroner or coroner's physician shall perform, at county expense, an autopsy on any person less than nineteen years of age who dies a sudden death, except that no autopsy needs to be performed if (a) the death was caused by a readily recognizable disease or the death occurred due to trauma resulting from an accident and (b) the death did not occur under suspicious circumstances. The Attorney General shall create, by July 1, 2007, guidelines for county coroners or coroner's physicians regarding autopsies on persons less than nineteen years of age.

(2) The county coroner or coroner's physician shall attempt to establish, by a reasonable degree of medical certainty, the cause or causes of the death, and shall thereafter certify the cause or causes of death to the county attorney. No cause of death shall be certified as sudden infant death syndrome unless an autopsy, a death scene investigation, and a review of the child's medical history reveal no other possible cause.

(3) A county may request reimbursement of up to fifty percent of the cost of an autopsy from the Attorney General. Reimbursement requests may include, but not be limited to, costs for expert witnesses and complete autopsies, including toxicology screens and tissue sample tests. The Attorney General shall place an emphasis on autopsies of children five years of age and younger.

When an autopsy is performed why are the grieving parents then charged for autopsy repair??? which is what happen to my son and his wife in the death of their 2 month old child. I have a lot of questions about this.

I am sorry for your loss. Are they being charged this autopsy repair fee by the funeral home? If so, it is probably because the funeral home has no way to bill the government for these services. Also, they might be considered optional services, performed only if requested by the family based on the type of services being performed (cremation vs. open casket, for example).

The family did not request the autopsy, it was mandated by the county attorney due to the fact that it happened in a daycare, which I get that. There are a lot of bad people in our world that need to be investigated. However, what would they do if they didn't repair the body? They tried desperately to have him be an organ donor and due to delays I feel caused by the county attorney, that all failed also. He was held on life support for many hours trying to get them to release the body for organ donation. By the time that all happened the organs were unable to be saved. I feel that my son and his wife, along with the rest of our family were put through a lot and hoping for him to be an organ donor was one thing that they held on to in hopes to make some sense of everything. They did donate to SIDS research in hopes to save another ones life and keep families from having to experience this terrible tragidy. If the law states that because they choose to see their child again, have an open casket, that this charge then becomes their financial responsibility is really really wrong and needs to be changed and I am going to make that my mission in life to see how that can be changed.
Thank you

I would like to give my sympathy to Carol, for what she had gone through with her children, regarding her grandson; I had lost one of my grandsons, at the tender age of 3 months, to SIDS; however, we got a bill from funeral director for 5 thousand, which we paid, through the assistance of "friends and family;" but we did not receive an 'itemized bill,' so I do not even know if we also were charged for the funeral home to 'fix' lil Jon's body after the county autopsy; I do know that the funeral director insisted that no one touch baby's body, as his bones were removed, as well as most of his insides, and his skin was stitched to his clothing for the private viewing [parents and grandparents], but baby was cremated before the public wake;
With that said, the state of NJ put my family through hell, filing charges of abuse against my son and his wife, taking my older grandson [then 3] into "protective custody" [aka, foster home], where he spent 9 months of his precious young life!! We were horrified over the death of my young grandson, and the state of NJ, as well as family court judges, were heartless to my family!!
