Terms Used In New Jersey Statutes 39:5-54

  • person: includes corporations, companies, associations, societies, firms, partnerships and joint stock companies as well as individuals, unless restricted by the context to an individual as distinguished from a corporate entity or specifically restricted to one or some of the above enumerated synonyms and, when used to designate the owner of property which may be the subject of an offense, includes this State, the United States, any other State of the United States as defined infra and any foreign country or government lawfully owning or possessing property within this State.   • Probable cause: A reasonable ground for belief that the offender violated a specific law.
  • State: extends to and includes any State, territory or possession of the United States, the District of Columbia and the Canal Zone. See New Jersey Statutes 1:1-2
2. Whenever a person with diplomatic immunity is stopped by a State, county or municipal law enforcement officer who has probable cause to believe that the person has violated N.J.S.2C:11-5, section 1 of P.L.2017, c.165 (C. 2C:11-5.3), subsection c. of N.J.S.2C:12-1, R.S.39:4-50, section 2 of P.L.1981, c.512 (C. 39:4-50.4a) or section 2 of P.L.1972, c.197 (C. 39:6B-2), or has committed a motor vehicle moving violation, the law enforcement officer shall:

a. As soon as practicable, contact the United States Department of State office to verify the driver’s status and immunity;

b. Record all relevant information from the person’s driver’s license or identification card, including a driver’s license or identification card issued by the United States Department of State;

c. Within five working days after the date of the stop, forward to the Division of Motor Vehicles the following information:

(1) A vehicle accident report if the person was involved in an accident;

(2) A copy of any citation or other charging document that was issued, if any; and

(3) A written report describing the incident if no citation or charging document was issued.
