Terms Used In Utah Code > Title 63H > Chapter 7a - Utah Communications Authority Act

  • Administrator: includes "executor" when the subject matter justifies the use. See Utah Code 68-3-12.5
  • Advice and consent: Under the Constitution, presidential nominations for executive and judicial posts take effect only when confirmed by the Senate, and international treaties become effective only when the Senate approves them by a two-thirds vote.
  • Aggregator site: means a website that provides access to information regarding insurance products from more than one insurer, including product and insurer information, for use in comparison shopping. See Utah Code 31A-23a-902
  • Application: means a document:
    (a) 
    (i) completed by an applicant to provide information about the risk to be insured; and
    (ii) that contains information that is used by the insurer to evaluate risk and decide whether to:
    (A) insure the risk under:
    (I) the coverage as originally offered; or
    (II) a modification of the coverage as originally offered; or
    (B) decline to insure the risk; or
    (b) used by the insurer to gather information from the applicant before issuance of an annuity contract. See Utah Code 31A-1-301
  • Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
  • Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
  • Authority: means the Utah Communications Authority created in Section 63H-7a-201. See Utah Code 63H-7a-103
  • Backhaul network: means the portion of a public safety communications network that consists primarily of microwave paths, fiber lines, or ethernet circuits. See Utah Code 63H-7a-103
  • Blanket travel insurance: means a travel insurance policy that:
    (a) an insurer issues to an eligible group; and
    (b) covers:
    (i) a specific class of persons defined in the policy; and
    (ii) all members of the eligible group without a separate charge to an individual member of the eligible group. See Utah Code 31A-23a-902
  • Board: means the Utah Communications Authority Board created in Section 63H-7a-203. See Utah Code 63H-7a-103
  • Business entity: means :
    (a) a corporation;
    (b) an association;
    (c) a partnership;
    (d) a limited liability company;
    (e) a limited liability partnership; or
    (f) another legal entity. See Utah Code 31A-1-301
  • CAD-to-CAD: means standardized connectivity between PSAPs or between a PSAP and a dispatch center for the transmission of data between CADs. See Utah Code 63H-7a-103
  • Cancellation fee waiver: means a contractual agreement that:
    (a) is between a supplier of a travel assistance service and the supplier's customer; and
    (b) waives a non-refundable cancellation fee provision of the supplier's underlying travel contract, with or without regard to:
    (i) the reason for the cancellation; or
    (ii) the form of reimbursement. See Utah Code 31A-23a-902
  • Certificate: means evidence of insurance given to:
    (a) an insured under a group insurance policy; or
    (b) a third party. See Utah Code 31A-1-301
  • Contract: A legal written agreement that becomes binding when signed.
  • Department: means the Insurance Department. See Utah Code 31A-1-301
  • Dispatch center: means an entity that receives and responds to an emergency or nonemergency communication transferred to the entity from a public safety answering point. See Utah Code 63H-7a-103
  • Employee: means :
    (a) an individual employed by an employer; or
    (b) an individual who meets the requirements of Subsection (53)(b). See Utah Code 31A-1-301
  • Exclusion: means for the purposes of accident and health insurance that an insurer does not provide insurance coverage, for whatever reason, for one of the following:
    (a) a specific physical condition;
    (b) a specific medical procedure;
    (c) a specific disease or disorder; or
    (d) a specific prescription drug or class of prescription drugs. See Utah Code 31A-1-301
  • Filed: means that a filing is:
    (i) submitted to the department as required by and in accordance with applicable statute, rule, or filing order;
    (ii) received by the department within the time period provided in applicable statute, rule, or filing order; and
    (iii) accompanied by the appropriate fee in accordance with:
    (A) Section 31A-3-103; or
    (B) rule. See Utah Code 31A-1-301
  • Filing: when used as a noun, means an item required to be filed with the department including:
    (a) a policy;
    (b) a rate;
    (c) a form;
    (d) a document;
    (e) a plan;
    (f) a manual;
    (g) an application;
    (h) a report;
    (i) a certificate;
    (j) an endorsement;
    (k) an actuarial certification;
    (l) a licensee annual statement;
    (m) a licensee renewal application;
    (n) an advertisement;
    (o) a binder; or
    (p) an outline of coverage. See Utah Code 31A-1-301
  • FirstNet: means the federal First Responder Network Authority established in 47 U. See Utah Code 63H-7a-103
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • Form: means one of the following prepared for general use:
    (i) a policy;
    (ii) a certificate;
    (iii) an application;
    (iv) an outline of coverage; or
    (v) an endorsement. See Utah Code 31A-1-301
  • Fulfillment material: means documentation that:
    (a) is sent to the purchaser of a travel protection plan;
    (b) confirms the purchase of the travel protection plan; and
    (c) provides the travel protection plan's coverage and assistance details. See Utah Code 31A-23a-902
  • Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
  • Individual: means a natural person. See Utah Code 31A-1-301
  • Insurance: includes :
    (i) a risk distributing arrangement providing for compensation or replacement for damages or loss through the provision of a service or a benefit in kind;
    (ii) a contract of guaranty or suretyship entered into by the guarantor or surety as a business and not as merely incidental to a business transaction; and
    (iii) a plan in which the risk does not rest upon the person who makes an arrangement, but with a class of persons who have agreed to share the risk. See Utah Code 31A-1-301
  • Insured: means a person to whom or for whose benefit an insurer makes a promise in an insurance policy and includes:
    (i) a policyholder;
    (ii) a subscriber;
    (iii) a member; and
    (iv) a beneficiary. See Utah Code 31A-1-301
  • Insurer: is a s defined in Section 31A-1-301, except that the following persons or similar persons are not insurers for purposes of 7:
    (a) a risk retention group as defined in:
    (i) the Superfund Amendments and Reauthorization Act of 1986, Pub. See Utah Code 31A-23a-102
  • Lease: means any lease, lease purchase, sublease, operating, management, or similar agreement. See Utah Code 63H-7a-103
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • License: includes a certificate of authority issued to an insurer. See Utah Code 31A-1-301
  • Limited lines travel insurance producer: means one of the following designated by an insurer as the travel insurance supervising entity as provided in Subsection 31A-23a-905(4):
    (a) a licensed managing general agent or third party administrator; or
    (b) a licensed insurance producer, including a limited lines producer. See Utah Code 31A-23a-902
  • Negotiate: means the act of conferring directly with or offering advice directly to a purchaser or prospective purchaser of a particular contract of insurance concerning a substantive benefit, term, or condition of the contract if the person engaged in that act:
    (a) sells insurance; or
    (b) obtains insurance from insurers for purchasers. See Utah Code 31A-23a-102
  • Offer and disseminate: means :
    (a) providing general information, including a description of the coverage and price;
    (b) processing an application;
    (c) collecting a premium; and
    (d) performing activities that the state permits to be done by a person who is not licensed. See Utah Code 31A-23a-902
  • Person: means :Utah Code 68-3-12.5
  • Person: includes :
    (a) an individual;
    (b) a partnership;
    (c) a corporation;
    (d) an incorporated or unincorporated association;
    (e) a joint stock company;
    (f) a trust;
    (g) a limited liability company;
    (h) a reciprocal;
    (i) a syndicate; or
    (j) another similar entity or combination of entities acting in concert. See Utah Code 31A-1-301
  • Policy: includes a service contract issued by:
    (i) a motor club under Chapter 11, Motor Clubs;
    (ii) a service contract provided under Chapter 6a, Service Contracts; and
    (iii) a corporation licensed under:
    (A) Chapter 7, Nonprofit Health Service Insurance Corporations; or
    (B) Chapter 8, Health Maintenance Organizations and Limited Health Plans. See Utah Code 31A-1-301
  • Policyholder: means a person who controls a policy, binder, or oral contract by ownership, premium payment, or otherwise. See Utah Code 31A-1-301
  • Process: means a writ or summons issued in the course of a judicial proceeding. See Utah Code 68-3-12.5
  • producer: means a person licensed or required to be licensed under the laws of this state to sell, solicit, or negotiate insurance. See Utah Code 31A-1-301
  • Property: includes both real and personal property. See Utah Code 68-3-12.5
  • PSAP: means an entity in this state that:
    (a) receives, as a first point of contact, direct 911 emergency communications from the 911 emergency service network requesting a public safety service;
    (b) has a facility with the equipment and staff necessary to receive the communication;
    (c) assesses, classifies, and prioritizes the communication; and
    (d) dispatches the communication to the proper responding agency. See Utah Code 63H-7a-103
  • Public agency: means any political subdivision of the state dispatched by a public safety answering point. See Utah Code 63H-7a-103
  • Public safety communications network: means :
    (a) a regional or statewide public safety governmental communications network and related facilities, including real property, improvements, and equipment necessary for the acquisition, construction, and operation of the services and facilities; and
    (b) 911 emergency services, including radio communications, connectivity, and 911 call processing equipment. See Utah Code 63H-7a-103
  • Quorum: The number of legislators that must be present to do business.
  • Rate: means :
    (i) the cost of a given unit of insurance; or
    (ii) for property or casualty insurance, that cost of insurance per exposure unit either expressed as:
    (A) a single number; or
    (B) a pure premium rate, adjusted before the application of individual risk variations based on loss or expense considerations to account for the treatment of:
    (I) expenses;
    (II) profit; and
    (III) individual insurer variation in loss experience. See Utah Code 31A-1-301
  • Resident: is a s defined by rule made by the commissioner in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act. See Utah Code 31A-23a-102
  • Sell: means to exchange a contract of insurance:
    (a) by any means;
    (b) for money or its equivalent; and
    (c) on behalf of an insurance company. See Utah Code 31A-23a-102
  • Solicit: means :
    (a) attempting to sell insurance;
    (b) asking or urging a person to apply for:
    (i) a particular kind of insurance; and
    (ii) insurance from a particular insurance company;
    (c) advertising insurance, including advertising for the purpose of obtaining leads for the sale of insurance; or
    (d) holding oneself out as being in the insurance business. See Utah Code 31A-23a-102
  • State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
  • Travel assistance service: includes :
    (i) a security advisory;
    (ii) destination information;
    (iii) a vaccination and immunization information service;
    (iv) a travel reservation service;
    (v) entertainment;
    (vi) activity and event planning;
    (vii) translation assistance;
    (viii) emergency messaging;
    (ix) an international legal or medical referral;
    (x) medical case monitoring;
    (xi) coordination of transportation arrangements;
    (xii) emergency cash transfer assistance;
    (xiii) medical prescription replacement assistance;
    (xiv) passport and travel document replacement assistance;
    (xv) lost luggage assistance; and
    (xvi) a concierge service. See Utah Code 31A-23a-902
  • Travel insurance: means insurance coverage for personal risks incident to planned travel, including:
    (i) interruption or cancellation of a trip or event;
    (ii) loss of baggage or personal effects;
    (iii) damages to accommodations or rental vehicles;
    (iv) sickness, accident, disability, or death during travel;
    (v) emergency evacuation;
    (vi) repatriation of remains; or
    (vii) a contractual obligation that indemnifies or pays a specified amount to the traveler upon a determinable contingency related to travel. See Utah Code 31A-23a-902
  • Travel protection plan: means a plan that provides:
    (a) travel insurance;
    (b) a travel assistance service; or
    (c) a cancellation fee waiver. See Utah Code 31A-23a-902
  • Travel retailer: means a business entity that:
    (a) makes, arranges, or offers a travel service; and
    (b) may offer and disseminate travel insurance as a service to the entity's customers on behalf of and under the direction of a limited lines travel insurance producer. See Utah Code 31A-23a-902
