Upon impanelment of each
grand jury, the judge managing the grand jury shall charge the grand jury and inform it of:
(1) |
its duty to inquire into offenses against the criminal laws alleged to have been committed within the jurisdiction; |

- Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
- Grand jury: agreement providing that a lender will delay exercising its rights (in the case of a mortgage,
- Indictment: The formal charge issued by a grand jury stating that there is enough evidence that the defendant committed the crime to justify having a trial; it is used primarily for felonies.
- Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
- Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
- Person: means :Utah Code 68-3-12.5

its independent right to call and interrogate witnesses; |
(3) |
its right to request the production of documents or other evidence, including exculpatory evidence; |
(4) |
the necessity of finding credible evidence of each material element of any crime charged before returning an indictment; |
(5) |
the need to be satisfied that clear and convincing evidence exists that tends to show that a crime was committed by the person or persons accused before returning an indictment; |
(6) |
its right to have the prosecutor present it with draft indictments for less serious charges than those originally requested by the prosecutor; |
(7) |
the obligation of secrecy; and |
(8) |
other duties and rights as the court finds advisable. |
