Terms Used In Idaho Code > Title 39 > Chapter 35 - Idaho Certified Family Homes

  • Abuse: means a nonaccidental act of sexual, physical or mental mistreatment or injury of a resident through the action or inaction of another individual. See Idaho Code 39-3502
  • Activities of daily living: means the performance of basic self-care activities in meeting an individual’s needs to sustain him in a daily living environment. See Idaho Code 39-3502
  • Adult: means a person who has attained the age of eighteen (18) years. See Idaho Code 39-3502
  • Assessment: means the conclusion reached using uniform criteria which identifies resident strengths, weaknesses, risks and needs, to include functional, medical and behavioral. See Idaho Code 39-3502
  • Board: means the board of health and welfare. See Idaho Code 39-3502
  • Care provider: means the adult member of the home family responsible for maintaining the certified family home. See Idaho Code 39-3502
  • Certified family home: means a family-styled living environment in which two (2) or fewer adults live who are not able to reside in their own home and who require care, help in daily living, protection and security, supervision, personal assistance and encouragement toward independence. See Idaho Code 39-3502
  • Client: means any person who receives financial aid and/or services from an organized program of the department. See Idaho Code 39-3502
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Department: means the Idaho department of health and welfare. See Idaho Code 39-3502
  • Director: means the director of the Idaho department of health and welfare. See Idaho Code 39-3502
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Exploitation: means the misuse of a vulnerable adult’s funds, property or resources by another person for profit or advantage. See Idaho Code 39-3502
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Home family: means all individuals related by blood, marriage or adoption, other than residents residing in the certified family home. See Idaho Code 39-3502
  • Month: means a calendar month, unless otherwise expressed. See Idaho Code 73-114
  • Neglect: means failure to provide food, clothing, shelter, or medical care necessary to sustain life and health of a resident. See Idaho Code 39-3502
  • Negotiated service agreement: means the agreement reached by the resident or their representative, if applicable, and the facility, based on the assessment, physician’s orders if any, admission records if any, and desires of the resident and which outlines services to be provided and the obligations of the certified family home and the resident. See Idaho Code 39-3502
  • person: includes a corporation as well as a natural person;

  • Personal assistance: means the provision by the certified family home of one (1) or more of the following services:

  • Personal property: includes money, goods, chattels, things in action, evidences of debt and general intangibles as defined in the uniform commercial code — secured transactions. See Idaho Code 73-114
  • Personal property: All property that is not real property.
  • Political subdivision: means a city or county. See Idaho Code 39-3502
  • Precedent: A court decision in an earlier case with facts and law similar to a dispute currently before a court. Precedent will ordinarily govern the decision of a later similar case, unless a party can show that it was wrongly decided or that it differed in some significant way.
  • Property: includes both real and personal property. See Idaho Code 73-114
  • Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
  • Representative of the department: means an employee of the department. See Idaho Code 39-3502
  • Resident: means an adult who lives in a certified family home and who requires personal assistance or supervision. See Idaho Code 39-3502
  • Room and board: means lodging and meals. See Idaho Code 39-3502
  • State: when applied to the different parts of the United States, includes the District of Columbia and the territories; and the words "United States" may include the District of Columbia and territories. See Idaho Code 73-114
  • Substantial compliance: means a certified family home has no core issue deficiencies. See Idaho Code 39-3502
  • Supervision: means administrative activity which provides the following: protection, guidance, knowledge of the resident’s whereabouts and monitoring activities. See Idaho Code 39-3502
  • Supportive services: means the specific services that are provided to the resident in the community and that are required by the negotiated service agreement or reasonably requested by the resident. See Idaho Code 39-3502
