76-2-1003. Right to mine digital assets. (1) A governing body of a city or town, the governing bodies of more than one city or town, the governing body of a county, or any combination of those governing bodies may not enact an ordinance, resolution, or rule that:

Terms Used In Montana Code 76-2-1003

  • Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.

(a)imposes requirements on a digital asset mining business that are not also requirements for data centers in its area of jurisdiction;

(b)prevents a digital asset mining business from operating in an area zoned for industrial use; or

(c)prevents home digital asset mining at a private residence, except as related to existing noise ordinances.

(2)Any digital asset mining business operating on or before May 2, 2023, may continue to operate regardless of any change in zoning or regulations.
