85-9-305. Entry of dissolution order. (1) The court shall enter an order dissolving the district when it appears to the satisfaction of the court that:

Terms Used In Montana Code 85-9-305

  • Court: means the district court of the judicial district in which the largest portion of the taxable valuation of real property of the proposed district is located and within the county in which the largest portion of the taxable valuation of real property of the proposed district is located within the judicial district. See Montana Code 85-9-103
  • District: means a conservancy district. See Montana Code 85-9-103
  • State: when applied to the different parts of the United States, includes the District of Columbia and the territories. See Montana Code 1-1-201

(a)all obligations of the district have been discharged;

(b)all the costs of termination have been paid.

(2)A certified copy of the order shall be recorded by the clerk of the court in all counties in which the district was situated and filed with the secretary of state.
