Terms Used In Utah Code 75-4-203

  • Decedent: A deceased person.
  • Nonresident decedent: means a decedent who was domiciled in another jurisdiction at the time of the decedent's death. See Utah Code 75-1-201 v2
  • Person: means an individual or an organization. See Utah Code 75-1-201 v2
  • Personal representative: includes executor, administrator, successor personal representative, special administrator, and persons who perform substantially the same function under the law governing their status. See Utah Code 75-1-201 v2
  • Property: includes both real and personal property or any interest therein and means anything that may be the subject of ownership. See Utah Code 75-1-201 v2
  • Resident creditor: means a person domiciled in, or doing business in this state, who is, or could be, a claimant against an estate of a nonresident decedent. See Utah Code 75-4-101

     Payment or delivery under Section 75-4-201 may not be made if a resident creditor of the nonresident decedent has notified the debtor of the nonresident decedent or the person having possession of the personal property belonging to the nonresident decedent that the debt should not be paid nor the property delivered to the domiciliary foreign personal representative.
