Sec. 5. (a) The authority is:

(1) a public body corporate and politic; and

authority: refers to the Indiana state park inns authority established by section 4 of this chapter. See Indiana Code 14-19-11-1

(2) an instrumentality of the state.

(b) The authority is separate from the state. However, the exercise of its powers is an essential governmental and public function.
