Sec. 3. (a) The local office shall maintain the medical record for a foster child when the child is placed in foster care. The record must remain with the child until:
(2) the child is adopted; or
(1) the child is returned to the natural parents;

- Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
- medical record: means written or printed information possessed by a provider (as defined in IC 16-18-2-295) concerning any diagnosis, treatment, or prognosis of the patient, unless otherwise defined. See Indiana Code 1-1-4-5
(3) a legal guardian is appointed for the child.
(b) Unless otherwise prohibited by state or federal law, the local office shall provide a copy of the medical record to the child or the child’s legal guardian after the child in need of services case or collaborative care case is closed.
