Sec. 2. The juvenile court shall do the following:
(2) Approve the filing of a petition if there is probable cause to believe that:
(1) Consider the preliminary inquiry and the evidence of probable cause.
Terms Used In Indiana Code 31-37-10-2
- Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
- juvenile: as used in this article means any person who is a minor under the law of the state of residence of the parent, guardian, person or agency entitled to the legal custody of such minor. See Indiana Code 31-37-23-1
- Probable cause: A reasonable ground for belief that the offender violated a specific law.
(A) the child is a delinquent child; and
(B) it is in the best interests of the child or the public that the petition be filed.
