Terms Used In Alabama Code 15-5-3
- Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
- person: includes a corporation as well as a natural person. See Alabama Code 1-1-1
- Probable cause: A reasonable ground for belief that the offender violated a specific law.
- property: includes both real and personal property. See Alabama Code 1-1-1
A search warrant can only be issued on probable cause, supported by an affidavit naming or describing the person and particularly describing the property and the place to be searched.
