Terms Used In Alabama Code 19-3B-301

  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. Source: OCC
  • Irrevocable trust: A trust arrangement that cannot be revoked, rescinded, or repealed by the grantor.
  • person: includes a corporation as well as a natural person. See Alabama Code 1-1-1
(b) The consent of a person who may represent and bind another person under this article is binding on the person represented unless the person represented objects to the representation before the consent would otherwise have become effective.
(c) Except as otherwise provided in Sections irrevocable trust by consent” class=”unlinked-ref” datatype=”S” sessionyear=”2020″ statecd=”AL” title=”19″>19-3B-411 and amendment of revocable trust” class=”unlinked-ref” datatype=”S” sessionyear=”2020″ statecd=”AL” title=”19″>19-3B-602, a person who under this article may represent a settlor who lacks capacity may receive notice and give a binding consent on the settlor’s behalf.
(d) A settlor may not represent and bind a beneficiary under this article with respect to the termination or modification of a trust under Section 19-3B-411(a).
