(a) An individual is entitled to exemption of the following property:

Terms Used In Alaska Statutes 09.38.015

  • burial plot: means a parcel of real estate that is used for burial of human remains and that is located within an area designated for cemetery purposes by the state or a municipality. See Alaska Statutes 09.38.500
  • Contract: A legal written agreement that becomes binding when signed.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Escrow: Money given to a third party to be held for payment until certain conditions are met.
  • exempt: means protected, and "exemption" means protection, from subjection to process or a proceeding to collect an unsecured debt. See Alaska Statutes 09.38.500
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • municipality: means a political subdivision incorporated under the laws of the state that is a home rule or general law city, a home rule or general law borough, or a unified municipality. See Alaska Statutes 01.10.060
  • property: includes real and personal property. See Alaska Statutes 01.10.060
  • Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.
  • state: means the State of Alaska unless applied to the different parts of the United States and in the latter case it includes the District of Columbia and the territories. See Alaska Statutes 01.10.060
  • victim: has the meaning given in Alaska Stat. See Alaska Statutes 09.38.500
(1) a burial plot for the individual and the individual’s family;
(2) health aids reasonably necessary to enable the individual or a dependent to work or to sustain health;
(3) benefits paid or payable for medical, surgical, or hospital care to the extent they are or will be used to pay for the care;
(4) an award under Alaska Stat. Chapter 18.67 (Violent Crimes Compensation Board) or a crime victim‘s reparations act of another jurisdiction;
(5) benefits paid or payable as a longevity bonus under Alaska Stat. Chapter 47.45;
(6) compensation or benefits paid or payable and exempt under federal law;
(7) liquor licenses granted under Alaska Stat. Title 4;
(8) tuition credit or savings accounts under an education savings account established under Alaska Stat. § 14.40.802 or an advance college tuition savings contract authorized under Alaska Stat. § 14.40.809 (a);
(9) a permanent fund dividend to the extent allowed under Alaska Stat. § 43.23.140;
(10) benefits paid or payable under Alaska Stat. § 47.45.30147.45.309.
(b) The right to benefits held by the state on behalf of an individual that may become payable by reason of disability, unemployment, or illness, amounts held in the teachers’, judicial, or public employees’ retirement system, or in the elected public officers’ retirement system under former Alaska Stat. Chapter 39.37, and child support collections made by the child support services agency are exempt.
(c) Property of the state, a municipality, and of the Alaska Municipal Bond Bank Authority or another state public corporation is exempt.
(d) Real property held by a cemetery association established under Alaska Stat. Chapter 10.30 for the purpose of a cemetery and not exceeding 80 acres is exempt.
(e) Money held in an escrow account under Alaska Stat. § 06.60.360 is exempt.
