(a) An individual applying for or receiving vocational rehabilitation who is aggrieved by the action or inaction of the agency is entitled to a fair hearing by the agency, in accordance with regulations.

  • action: includes any matter or proceeding in a court, civil or criminal. See Alaska Statutes 01.10.060
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.

(b) A blind person or a person with a severe disability aggrieved by a decision or action of the agency under Alaska Stat. § 23.15.13323.15.135 shall receive a hearing on request in accordance with Alaska Stat. § 44.62.33044.62.630 (Administrative Procedure Act). A blind person may also file a complaint in accordance with 20 U.S.C. §§ 107d-1 for arbitration of a grievance.
