A person brought into this state on extradition based on a criminal charge shall not be subject to service of personal process in civil actions arising out of the same facts as the criminal proceedings to answer which he is returned, until he has been convicted in the criminal proceeding, or, if acquitted, until he has had ample opportunity to return to the state from which he was extradited.

  • Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
  • Extradition: The formal process of delivering an accused or convicted person from authorities in one state to authorities in another state.
  • Person: means a human being and, as the context requires, an enterprise, a public or private corporation, an unincorporated association, a partnership, a firm, a society, a government, a governmental authority or an individual or entity capable of holding a legal or beneficial interest in property.   • Process: means a citation, writ or summons issued in the course of judicial proceedings. See Arizona Laws 1-215
