Terms Used In Arizona Laws 14-10708

  • Court: means the superior court. See Arizona Laws 14-1201
  • Terms of a trust: means the manifestation of the settlor's intent regarding a trust's provisions as expressed in the trust instrument or as may be established by other evidence that would be admissible in a judicial proceeding. See Arizona Laws 14-10103
  • Trust: includes an express trust, private or charitable, with any additions, wherever and however created. See Arizona Laws 14-1201
  • Trustee: A person or institution holding and administering property in trust.
  • Trustee: includes an original, additional and successor trustee and a cotrustee. See Arizona Laws 14-10103

B. If the terms of a trust specify the trustee’s compensation or refer to another ascertainable source for determining that compensation, the trustee is entitled to be compensated as specified, but the court may allow more or less compensation if either:

1. The duties of the trustee are substantially different from those contemplated when the trust was created.

2. The compensation specified by the terms of the trust would be unreasonably low or high.
