A. When the owner of a motor vehicle, trailer or semitrailer that is stolen or embezzled files an affidavit with the department alleging the vehicle is stolen or embezzled, the department shall immediately suspend registration of the vehicle and shall not transfer the registration or reregister the vehicle until it is notified that the owner has recovered the vehicle.

  • Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
  • Department: means the department of transportation acting directly or through its duly authorized officers and agents. See Arizona Laws 28-101

  • Owner: means :

    (a) A person who holds the legal title of a vehicle. See Arizona Laws 28-101

  • Semitrailer: means a vehicle that is with or without motive power, other than a pole trailer or single-axle tow dolly, that is designed for carrying persons or property and for being drawn by a motor vehicle and that is constructed so that some part of its weight and that of its load rests on or is carried by another vehicle.   • Trailer: means a vehicle that is with or without motive power, other than a pole trailer or single-axle tow dolly, that is designed for carrying persons or property and for being drawn by a motor vehicle and that is constructed so that no part of its weight rests on the towing vehicle. B. The affidavit is effective only during the current registration year in which given, but if during that year the vehicle is not recovered, the owner may file a new affidavit with like effect for the ensuing year.

C. An owner who has filed an affidavit of theft or embezzlement shall immediately notify the department of the recovery of the vehicle.
