  • Agency: means any statewide office, nonelective officer, department, division, bureau, board, commission or agency in the executive branch of the state government, except that it shall not apply to any agency whose primary function is service to the Legislature or judicial branches of state government or to any agency that is administered by an elective officer.   • Authority: means an entity established by the state that requires its members, including, but not limited to, local government entities, to adopt a resolution stating their intent to participate. See California Education Code 32390
  • Benefit corporation: means a corporation organized under the General Corporation Law that has elected to become subject to this part and whose status as a benefit corporation has not been terminated as provided in this part. See California Education Code 35766
  • Benefit enforcement proceeding: means a claim or action relating to any of the following:

  • Board: means the Wildlife Conservation Board created pursuant to Article 2 (commencing with Section 1320) of Chapter 4 of Division 20 of the Fish and Game Code. See California Education Code 32310
  • Bond: means a bond, authorized by Sections 8878. See California Government Code 12012.90
  • Civil engineer: as used in this chapter means a professional engineer in the branch of civil engineering and refers to one who practices or offers to practice civil engineering in any of its phases. See California Government Code 27491.41
  • Commission: means the Educational Innovation and Planning Commission. See California Education Code 33509
  • Commission: means the Seismic Safety Commission. See California Government Code 12030
  • Committee: means the California Earthquake Safety and Housing Rehabilitation Finance Committee. See California Government Code 12012.90
  • Committee: means the Earthquake Safety and Public Buildings Rehabilitation Finance Committee created pursuant to subdivision (a) of Section 8878. See California Government Code 12030
  • company: as used in this division means a premium finance agency as defined in Section 18560. See California Health and Safety Code 33360.5
  • Covered establishment: means any industrial or commercial facility or part thereof that employs, or has employed within the preceding 12 months, 75 or more persons. See California Public Utilities Code 100409
  • creditor: means the state or the department or agency of the state seeking to collect the liability. See California Code of Civil Procedure 688.040
  • debtor: means the debtor from whom the liability is sought to be collected. See California Code of Civil Procedure 688.040
  • Department: means the Department of Conservation. See California Education Code 32390
  • Department: means Department of Housing and Community Development. See California Government Code 12012.90
  • Direct service contract: means any contract provided by a state agency pursuant to Chapter 4 (commencing with Section 38030). See California Government Code 12012.62
  • Director: means the Director of Industrial Relations or his or her designee. See California Public Utilities Code 100131
  • directors: means natural persons, designated in the articles or bylaws or elected by the incorporators, and their successors and natural persons designated, elected, or appointed by any other name or title to act as members of the governing body of the corporation. See California Government Code 31781.11
  • disaster: means a war or enemy-caused calamity occurring in the State of California, such as an attack by nuclear weapons, as a result of which the incumbent Governor is either killed, missing or so seriously injured as to be unable to perform his duties. See California Government Code 12060
  • Electrical engineer: as used in this chapter means a professional engineer in the branch of electrical engineering and refers to one who practices or offers to practice electrical engineering in any of its phases. See California Government Code 27491.43
  • Employee: means a person employed by an employer for at least 6 months of the 12 months preceding the date on which notice is required. See California Public Utilities Code 100409
  • Employer: means any person, as defined by Section 18, who directly or indirectly owns and operates a covered establishment. See California Public Utilities Code 100409
  • Financial and compliance audit: means a systematic review or appraisal to determine each of the following:

  • Fund: means the Housing Rehabilitation Loan Fund established by Section 50661 of the Health and Safety Code. See California Government Code 12012.90
  • Fund: means the Earthquake Safety and Public Buildings Rehabilitation Fund of 1990 created pursuant to Section 8878. See California Government Code 12030
  • General public benefit: means a material positive impact on society and the environment, taken as a whole, as assessed against a third-party standard, from the business and operations of a benefit corporation. See California Education Code 35766
  • Generally accepted auditing standards: means the auditing standards set forth in the financial and compliance element of the "Standards for Audit of Governmental Organizations, Programs, Activities, and Functions" issued by the Comptroller General of the United States and incorporating the audit standards of the American Institute of Certified Public Accountants. See California Government Code 12012.62
  • Grant program: means the program established pursuant to Section 10280. See California Education Code 32390
  • Horticultural: includes the curing and drying but not the canning of all varieties of fruit. See California Public Utilities Code 100381
  • Independent auditors: means public accountants who have no direct or indirect relationship with the functions or activities being audited or with the business conducted by any of the officials or contractors being audited. See California Government Code 12012.62
  • Joint powers authority: means a joint powers authority established pursuant to Chapter 5 (commencing with Section 6500) of Division 7 of Title 1 of the Government Code that is formed in part to protect agricultural land. See California Education Code 32390
  • Layoff: means a separation from a position for lack of funds or lack of work. See California Public Utilities Code 100409
  • Local agency: means any city, city and county, or county. See California Government Code 12012.90
  • Local government: means any city, county, city and county, or special district. See California Government Code 12030
  • Local government building or facility: means an existing essential services building, as defined in Section 16007 of the Health and Safety Code, or an emergency or public safety local building as identified in Section 8878. See California Government Code 12030
  • Local government entity: means any city, county, city and county, or district, including, but not limited to, park and open-space districts, resource conservation districts, and other special districts. See California Education Code 32390
  • Mass layoff: means a layoff during any 30-day period of 50 or more employees at a covered establishment. See California Public Utilities Code 100409
  • Mechanical engineer: as used in this chapter means a professional engineer in the branch of mechanical engineering and refers to one who practices or offers to practice mechanical engineering in any of its phases. See California Government Code 27491.44
  • Minimum status vote: means that:

  • Minor: means any person under the age of 18 years who is required to attend school under Chapter 2 (commencing with Section 48200) and Chapter 3 (commencing with Section 48400) of Part 27 of the Education Code and any person under the age of six years.   • Nonprofit organization: means any nonprofit public benefit corporation that has among its purposes the conservation of agricultural lands, and holds a tax exemption, as defined under Section 501(c)(3) of the Internal Revenue Code, and further qualifies as an organization under Section 170(b)(1)(A)(iv) or 170(h)(3) of the Internal Revenue Code.   • Nonprofit organization: means an organization described in Section 501(c)(3) of the Internal Revenue Code of 1986 that is exempt from taxation under Section 501(a) of that code or any nonprofit, scientific or educational organization qualified under Section 23701d of the Revenue and Taxation Code.   • office: means the Office of Emergency Services. See California Government Code 12030
  • Project: means a program of work to retrofit, reconstruct, repair, replace, or relocate, for local government-owned facilities only, a building, facility, or both, which is owned by any city, county, city and county, or special district and which is included in an application for a grant of funds. See California Government Code 12030
  • Relocation: means the removal of all or substantially all of the industrial or commercial operations in a covered establishment to a different location 100 miles or more away. See California Public Utilities Code 100409
  • Reorganization: means :

  • Resolution: means a resolution of either house of the Legislature resolving as follows:

  • Retrofit: means to either strengthen the structure of a building or facility, or to provide the means necessary to reduce the seismic force level experienced by a building or facility during an earthquake, so as to significantly reduce hazards to life and safety while concomitantly providing for the substantially safe egress of occupants during and immediately after such an earthquake.   • Specific public benefit: includes all of the following:

  • State Architect: means the Office of the State Architect. See California Government Code 12030
  • State building or facility: means any building or structure owned by a state agency, which is identified pursuant to Section 8878. See California Government Code 12030
  • State plan: means the plan for the use of Title IV funds as approved by the State Board of Education. See California Education Code 33509
  • Termination: means the cessation or substantial cessation of industrial or commercial operations in a covered establishment. See California Public Utilities Code 100409
  • Third-party standard: means a standard for defining, reporting, and assessing overall corporate social and environmental performance to which all of the following apply:
