When it is necessary for the commissioner to construct a highway which intersects or crosses over or under any railroad, said commissioner may order any railroad company to change or alter its existing facilities as required by such construction. The cost of such change or alteration shall be included in the construction costs of such highway.

  • Commissioner: means the Commissioner of Transportation and includes each successor in office or authority. See Connecticut General Statutes 13a-1
  • Highway: includes streets and roads. See Connecticut General Statutes 13a-1
  • railroad company: shall be construed to mean and include all corporations, trustees, receivers or other persons, that lay out, construct, maintain or operate a railroad, unless such meaning would be repugnant to the context or to the manifest intention of the General Assembly.
