(a) Except as provided in subsection (b) of this section, no business entity with a dealer registration may sell or offer for sale at the place of business identified in the business entity’s application for dealer registration, an electronic nicotine delivery system or a vapor product by any means other than an employee-assisted sale where the customer has no direct access to the electronic nicotine delivery system or vapor product except through the assistance of the employee of such business entity.

Terms Used In Connecticut General Statutes 21a-416

  • Business entity: means any corporation, limited liability company, association, partnership, sole proprietorship, government, governmental subdivision or agency, business trust, estate, trust or any other legal entity. See Connecticut General Statutes 21a-415
  • Dealer registration: means an electronic nicotine delivery system certificate of dealer registration issued by the Commissioner of Consumer Protection pursuant to this section. See Connecticut General Statutes 21a-415
  • Electronic nicotine delivery system: means an electronic device used in the delivery of nicotine or other substances to a person inhaling from the device, and includes, but is not limited to, an electronic cigarette, electronic cigar, electronic cigarillo, electronic pipe or electronic hookah and any related device and any cartridge or other component of such device, including, but not limited to, electronic cigarette liquid. See Connecticut General Statutes 21a-415
  • sell: means an act done intentionally by any person, whether done as principal, proprietor, agent, servant or employee, of transferring, or offering or attempting to transfer, for consideration, including bartering or exchanging, or offering to barter or exchange. See Connecticut General Statutes 21a-415
  • Vapor product: means any product that employs a heating element, power source, electronic circuit or other electronic, chemical or mechanical means, regardless of shape or size, to produce a vapor that may include nicotine and is inhaled by the user of such product. See Connecticut General Statutes 21a-415

(2) No business entity may sell or offer for sale an electronic nicotine delivery system or a vapor product from a self-service display.

(b) The provisions of subsection (a) of this section shall not apply to a business entity with a dealer registration if persons under the age of twenty-one are prohibited from entering the place of business identified in the business entity’s application for dealer registration and the prohibition on persons under the age of twenty-one entering such place of business is posted clearly on all entrances of such place of business.
