(a) All complaints shall be received and investigated by the Division in accordance with § 8735 of Title 29.
Terms Used In Delaware Code Title 24 Sec. 4115
- Board: shall mean the State Board of Home Inspectors established in this chapter. See Delaware Code Title 24 Sec. 4102
- Division: shall mean the State Division of Professional Regulation. See Delaware Code Title 24 Sec. 4102
- Home: shall mean any residential property, or manufactured or modular home, which is a single-family dwelling, duplex, triplex, quadruplex, condominium unit, or cooperative unit. See Delaware Code Title 24 Sec. 4102
- State: shall mean the State of Delaware. See Delaware Code Title 24 Sec. 4102
(b) When it is determined that an individual is engaging, or has engaged, in the practice of home inspection, or is using the title “home inspector” or other title implying that the individual is competent to act as a “home inspector” and is not licensed under the laws of this State, the Board may institute proceedings under § 10161 of Title 29 for issuance of a cease and desist order and a fine.
