Terms Used In Rhode Island General Laws > Chapter 5-65.1 - Home Inspectors

  • agency: means any executive, legislative, judicial, regulatory, or administrative body of the state or any political subdivision thereof, including, but not limited to: public officials elected or appointed; any department, division, agency, commission, board, office, bureau, authority; any school, fire, or water district; or other agency or quasi-public agency of state or local government that exercises governmental functions.   • Associate home inspector: means a person who is employed by a licensed home inspector to conduct a home inspection of a residential building on behalf of a client for a fee under the direct supervision of the licensed home inspector and is licensed pursuant to the provisions of this chapter. See Rhode Island General Laws 5-65.1-2
  • Board: means the contractors' registration and licensing board. See Rhode Island General Laws 5-65.1-2
  • Client: means any person who engages, or seeks to engage, the services of a home inspector for the purpose of obtaining an inspection of, and written report upon, the condition of a residential building. See Rhode Island General Laws 5-65.1-2
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Contract: A legal written agreement that becomes binding when signed.
  • Conviction: A judgement of guilt against a criminal defendant.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Fraud: Intentional deception resulting in injury to another.
  • Home inspection: means an inspection and a written evaluation of the following readily visible and accessible components of a residential building: heating, cooling, plumbing, and electrical systems, structural components, foundation, roof, masonry structure, exterior and interior components, and any other related residential housing components, unless the scope of the inspection is otherwise clearly limited, in writing, in the inspection report.   • Home inspector: means any person licensed as a home inspector to conduct a home inspection of a residential building on behalf of a client for a fee pursuant to the provisions of this chapter. See Rhode Island General Laws 5-65.1-2
  • in writing: include printing, engraving, lithographing, and photo-lithographing, and all other representations of words in letters of the usual form. See Rhode Island General Laws 43-3-16
  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • Nolo contendere: No contest-has the same effect as a plea of guilty, as far as the criminal sentence is concerned, but may not be considered as an admission of guilt for any other purpose.
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • person: may be construed to extend to and include co-partnerships and bodies corporate and politic. See Rhode Island General Laws 43-3-6
  • Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.
  • real estate: may be construed to include lands, tenements, and hereditaments and rights thereto and interests therein. See Rhode Island General Laws 43-3-10
  • Residential building: means a structure consisting of one or more residences and their appurtenances. See Rhode Island General Laws 5-65.1-2
  • United States: include the several states and the territories of the United States. See Rhode Island General Laws 43-3-8
