(1) No person shall:

(a) Practice nursing home administration unless the person holds an active license to practice nursing home administration.

Terms Used In Florida Statutes 468.1745

  • Board: means the Board of Nursing Home Administrators. See Florida Statutes 468.1655
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Nursing home: means an institution or facility licensed as such under part II of chapter 400. See Florida Statutes 468.1655
  • Nursing home administrator: means a person who is licensed to engage in the practice of nursing home administration in this state under the authority of this part. See Florida Statutes 468.1655
  • person: includes individuals, children, firms, associations, joint adventures, partnerships, estates, trusts, business trusts, syndicates, fiduciaries, corporations, and all other groups or combinations. See Florida Statutes 1.01
  • Practice of nursing home administration: means any service requiring nursing home administration education, training, or experience and the application of such to the planning, organizing, staffing, directing, and controlling of the total management of a nursing home. See Florida Statutes 468.1655
(b) Use the name or title “nursing home administrator” when the person has not been licensed pursuant to this act.
(c) Present as his or her own the license of another.
(d) Give false or forged evidence to the board or a member thereof for the purpose of obtaining a license.
(e) Use or attempt to use a nursing home administrator‘s license which has been suspended or revoked.
(f) Knowingly employ unlicensed persons in the practice of nursing home administration.
(g) Knowingly conceal information relative to violations of this part.
(2) Any person who violates the provisions of this section is guilty of a misdemeanor of the second degree, punishable as provided in s. 775.082 or s. 775.083.
