Terms Used In Florida Statutes 717.1331
- Department: means the Department of Financial Services. See Florida Statutes 717.101
- Holder: means a person, wherever organized or domiciled, who is:(a) In possession of property belonging to another;(b) A trustee in case of a trust; or(c) Indebted to another on an obligation. See Florida Statutes 717.101
- Subpoena: A command to a witness to appear and give testimony.
The department may initiate, or cause to be initiated, an action against a holder to enforce a subpoena or recover unclaimed property. If the department prevails in a civil or administrative action to enforce a subpoena or recover unclaimed property initiated by or on behalf of the department, the holder shall be ordered to pay the department reasonable costs and attorney’s fees.
