Oregon Statutes 249.016 – Nomination of candidates of major political party or for nonpartisan office
A candidate of a major political party for public office or a candidate for nonpartisan office shall be nominated only in the manner provided in ORS § 249.016 to 249.205. [1957 c.608 § 65 (2); 1979 c.190 § 102; 1993 c.797 § 7; 2001 c.721 § 4]
Terms Used In Oregon Statutes 249.016
- Candidate: means an individual whose name is or is expected to be printed on the official ballot or a write-in candidate. See Oregon Statutes 249.002
- Nonpartisan office: means the office of judge, Commissioner of the Bureau of Labor and Industries, any elected office of a metropolitan service district under ORS Chapter 268, justice of the peace, county clerk, county assessor, county surveyor, county treasurer, county judge who exercises judicial functions, sheriff, district attorney or any office designated nonpartisan by a home rule charter. - Public office: means any national, state, county, city or district office or position, except a political party office, filled by the electors. See Oregon Statutes 249.002
Chapter 220, Oregon Laws 2023, was referred to the people for their approval or rejection at the regular general election to be held throughout this state on November 5, 2024. If chapter 220, Oregon Laws 2023, is approved by the people, section 7 becomes operative January 1, 2028, and applies to elections and nominations occurring on or after January 1, 2028. See sections 18, 19 and 20, chapter 220, Oregon Laws 2023. Sections 6 and 7, chapter 220, Oregon Laws 2023, provide:
Section 7 of this 2023 Act is added to and made a part of ORS Chapter 249. [2023 c.220 § 6]
(1) Notwithstanding ORS § 249.016 or any other provision of law:
(a) There may not be a nominating election for the office of Commissioner of the Bureau of Labor and Industries; and
(b) The office of Commissioner of the Bureau of Labor and Industries shall be elected at the primary election by ranked choice voting conducted in the manner set forth in section 4 of this 2023 Act.
(2) Except as otherwise expressly provided by this section or other law, the requirements of ORS § 249.016 to 249.205 apply to candidates for the office of Commissioner of the Bureau of Labor and Industries. [2023 c.220 § 7]
