Terms Used In 10 Guam Code Ann. § 34127

  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Probable cause: A reasonable ground for belief that the offender violated a specific law.
If there is probable cause to believe that any animal is being subjected to treatment in violation of 9 Guam Code Ann. §§ 70.10 through
70.20, a peace officer or volunteer, under exigent circumstances,
may enter the premises to impound the animal. Notice of said impoundment shall be conspicuously posted on the premises.

(a) A peace officer or volunteer is not liable for any damages for an entry under this Section unless the damages were caused by reckless behavior.

(b) Any animal so impounded shall be held at the animal care facility designated pursuant to 10 GCA § 34118.

2021 NOTE: Due to the reorganization of Chapter 70, Title 9 Guam Code Ann. and the renumbering of Article 1 of Chapter 70, the reference to § 70.10.2 has been replaced with § 70.20.

It is unclear whether the authority granted by this provision extends to the other criminal offenses added by P.L. 35-144 (Jan. 22, 2021), codified at Article 1 of Chapter 70, Title 9 Guam Code Ann..
