Terms Used In 21 Guam Code Ann. § 76210

  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • Public law: A public bill or joint resolution that has passed both chambers and been enacted into law. Public laws have general applicability nationwide.
It is the declared intention of the Legislature that field investigations on privately owned lands should be discouraged except in accordance with both the provisions and spirit of this Chapter; and persons having knowledge of the location of archaeological sites are encouraged to communicate such information to the Department.

§ 76211. Vandalism and Unlawful Taking of Historic
Properties and Sites.

It shall be unlawful for any person to take, appropriate, evacuate, injure, or destroy any prehistoric or historic ruin or monument or object of antiquity situated on lands owned or controlled by Guam without the permission of the Department.Any person, firm or contractor who violates this Section shall be guilty of a petty misdemeanor and shall be fined not more than Five Thousand Dollars ($5,000) or imprisoned not more than sixty (60) days or both. Any prehistorical and historical objects and remains which have been taken without a permit shall be seized, deposited, and preserved in public museums by the Department.
