Terms Used In 22 Guam Code Ann. § 32104

  • Oath: A promise to tell the truth.
A Guam Board of Registration for Professional Engineers, Architect and Land Surveyors is created whose duty shall be to administer the provisions of this Chapter.

(a) The Board shall consist of seven (7) members, at least two (2) being female, to be constituted as follows: the Director of Public Works, five (5) members who shall be registered under the provisions of this Chapter and one (1) member of the general public who shall not have been registered under the provisions of this Chapter, or practicing in any of the professions covered by this Chapter. Except for the Director of Public Works, a member shall be appointed by I Maga’lahen Guåhan (Governor) for a term of four (4) years. Of the five (5) registered professional members, two (2) shall be registered architects (of which one (1) may be a landscape architect), two (2) shall be professional engineers, and one (1) shall be a professional land surveyor.

(b) The Chairman, Vice-Chairman and Secretary/Treasurer shall be elected annually by majority vote of the Board members at the first regular meeting of the Board after January 1.

(c) Each member of the Board shall receive a notice of his appointment from I Maga’lahen Guåhan (Governor) and shall take an oath for the faithful discharge of his duties. Appointments to the Board shall be in such manner so that the term of each member shall expire at a different time. On the expiration of the term of any member, I Maga’lahen Guåhan (Governor) shall appoint a successor. A member may be reappointed to succeed himself but for not more than two (2) consecutive terms. Each member may hold office until the expiration of the term for which appointed or until his successor has been duly appointed and qualified.

(d) In the event of a vacancy on the Board for any reason, resulting in an unexpired term and I Maga’lahen Guåhan (Governor) fails to appoint a successor within three (3) months after the vacancy

occurs, the Board may appoint a provisional member to serve in the interim until I Maga’lahen Guåhan (Governor) makes an appointment.
