If the person indicted or charged is subsequently convicted, the person, firm, corporation, partnership, association, or other legal entity which entered into a contract of the type identified in section 35181 shall:

(1) Deposit fifty per cent of the monetary compensation paid under such contract into a collection account established by the commission pursuant to section 35183 and deposit the other fifty per cent of such monetary compensation in a special account established by the commission pursuant to section 35184 if a timely appeal from the conviction is filed and the contract provides that monetary compensation is payable to the convicted person; or

Terms Used In Hawaii Revised Statutes 351-82

  • Affirmed: In the practice of the appellate courts, the decree or order is declared valid and will stand as rendered in the lower court.
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Appellate: About appeals; an appellate court has the power to review the judgement of another lower court or tribunal.
  • Commission: means the crime victim compensation commission established by this chapter. See Hawaii Revised Statutes 351-2
  • Contract: A legal written agreement that becomes binding when signed.
  • Conviction: A judgement of guilt against a criminal defendant.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
(2) Deposit all monetary compensation paid under such contract with the commission to a special account established pursuant to section 35184, if a timely appeal from the conviction is:

(A) Filed and the contract provides that the monetary compensation is payable to a person other than the convicted person;
(B) Filed, the conviction is affirmed on appeal, and no further appellate action is allowed; or
(C) Not filed.
