Terms Used In Idaho Code > Title 54 > Chapter 45 - Public Works Construction Management Licensing Act

  • Administrator: means the administrator of the Idaho division of occupational and professional licenses. See Idaho Code 54-4503
  • Applicant: means an individual who applies for a license or interim license pursuant to the provisions of this chapter. See Idaho Code 54-4503
  • Board: means the public works contractors license board established in section 54-1905, Idaho Code. See Idaho Code 54-4503
  • Certificate of authority: means a certificate issued by the division of occupational and professional licenses authorizing a firm to provide or hold itself out as providing construction manager services. See Idaho Code 54-4503
  • Construction management services: means representation of an owner in public works construction by a person with substantial discretion and authority to plan including scheduling, estimating and approval, coordinate, manage or direct phases of a project for the construction, demolition, alteration, repair or reconstruction of any public work. See Idaho Code 54-4503
  • Construction manager: means an individual who performs construction management services. See Idaho Code 54-4503
  • Contract: A legal written agreement that becomes binding when signed.
  • Conviction: A judgement of guilt against a criminal defendant.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Firm: means any business organization, including individuals, partnerships, corporations, associations or any combination thereof acting as a unit. See Idaho Code 54-4503
  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • Licensure: means the issuance of a license to an applicant under the provisions of this chapter authorizing such individual to offer and perform construction management services. See Idaho Code 54-4503
  • offer: means the representation by a person that the person possesses a valid construction manager license issued pursuant to the provisions of this chapter authorizing that person to provide construction management services. See Idaho Code 54-4503
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Person: includes an individual, partnership, corporation, association or other organization. See Idaho Code 54-4503
  • State: when applied to the different parts of the United States, includes the District of Columbia and the territories; and the words "United States" may include the District of Columbia and territories. See Idaho Code 73-114
  • Temporary restraining order: Prohibits a person from an action that is likely to cause irreparable harm. This differs from an injunction in that it may be granted immediately, without notice to the opposing party, and without a hearing. It is intended to last only until a hearing can be held.
