Terms Used In Idaho Code > Title 6

  • Abstract of judgment: In a federal criminal proceeding, A certification from a U.S. District Court clerk that a judgment of restitution was entered against the defendant owing to the victim. If the defendant inherits, owns, or sells real property or holdings, these assets can then be attached at the state and local levels as well.
  • Accepted agricultural practices: means those management practices normally associated with agriculture in Idaho, and which should include management practices intended to control odor generated by an agricultural operation. See Idaho Code 25-3803
  • Account: means any deposit or credit account with a bank, including a demand, time, savings, passbook, share draft, or like account, other than an account evidenced by a certificate of deposit;

  • Account: means a contract of deposit of funds between a depositor and a financial institution, and includes a checking account, savings account, certificate of deposit, share account and other like arrangement;
  • Idaho Code 15-6-101
  • Account: means an individual trust account or savings account established as prescribed in this chapter. See Idaho Code 33-5401
  • Account owner: means the person or state or local government organization designated in the agreement governing the account as having the right to withdraw moneys from the account before the account is disbursed to or for the benefit of the designated beneficiary. See Idaho Code 33-5401
  • Accredited institution of higher education: means any public or private university, college, or community college in Idaho accredited by the northwest association of schools and colleges, or any public professional-technical school operated by the state of Idaho or any political subdivision thereof; provided, that no institution of higher education shall be eligible to participate in the program unless it agrees to and complies with program rules adopted by the board pursuant to chapter 52, title 67, Idaho Code; provided, further, that private accredited institutions of higher education which are controlled by sectarian organizations, and students attending such institutions, may participate only in the educational need, off-campus work experience portion of this program and such off-campus employment may not be located at, or be performed on behalf of, a sectarian or religious establishment.   • Acquittal:
    1. Judgement that a criminal defendant has not been proved guilty beyond a reasonable doubt.
    2. A verdict of "not guilty."
     
  • Act: means the "Idaho Escrow Act" chapter 9, title 30, Idaho Code. See Idaho Code 30-902
  • Action: means any civil lawsuit or action in contract or tort for damages or indemnity brought against a construction professional to assert a claim, whether by complaint, counterclaim or cross-claim, for damage or the loss of use of real or personal property caused by a defect in the construction of a residence or in the substantial remodel of a residence. See Idaho Code 28-2-311
  • Adjourn: A motion to adjourn a legislative chamber or a committee, if passed, ends that day's session.
  • Administrative only district: is a library district that does not serve the public directly and has no direct service outlets or collections, but which contracts with other library entities to provide various public library services. See Idaho Code 33-2702
  • Administrative schools: means and applies to all elementary schools and kindergartens within a district that are situated ten (10) miles or less from both the other elementary schools and the principal administrative office of the district and all secondary schools within a district that are situated fifteen (15) miles or less from other secondary schools of the district. See Idaho Code 33-1001
  • Administrative staff: means those who hold an administrator certificate and are employed as a superintendent, an elementary or secondary school principal, or are assigned administrative duties over and above those commonly assigned to teachers. See Idaho Code 33-1001
  • Administrator: means the administrator, or his designee, for the animal industries division of the Idaho department of agriculture. See Idaho Code 22-4904
  • Administrator: means the person, officer or agency designated to operate a consolidated emergency communications system, and to receive funds for such an operation. See Idaho Code 31-4802
  • Administrator: means the administrator of the division of animal industries, Idaho state department of agriculture, or his designee. See Idaho Code 25-239
  • Administrator: means the director of the Idaho department of finance or his designee. See Idaho Code 30-14-102
  • Administrator: means the state treasurer or his or her duly authorized agents or employees. See Idaho Code 28-46-101
  • Adult household member: means any individual eighteen (18) years of age and over who resides in the household. See Idaho Code 31-3403
  • Adverse action: means to discharge, threaten or otherwise discriminate against an employee in any manner that affects the employee’s employment, including compensation, terms, conditions, location, rights, immunities, promotions or privileges. See Idaho Code 28-1-307
  • Advice and consent: Under the Constitution, presidential nominations for executive and judicial posts take effect only when confirmed by the Senate, and international treaties become effective only when the Senate approves them by a two-thirds vote.
  • Affirmed: In the practice of the appellate courts, the decree or order is declared valid and will stand as rendered in the lower court.
  • AFO: means a lot or facility where the following conditions are met:

  • Afternoon: means the period of a day between noon and midnight;
  • Idaho Code 28-4-104
  • Agent: means an individual, other than a broker-dealer, who represents a broker-dealer in effecting or attempting to effect purchases or sales of securities or who represents an issuer in effecting or attempting to effect purchases or sales of the issuer's securities. See Idaho Code 30-14-102
  • Agreement: means any agreement between a distributor and a supplier, whether oral or written, whereby a distributor is granted the right to purchase a brand, or brands, of beer sold by a supplier and to resell such products within the state of Idaho. See Idaho Code 23-1102
  • Agricultural operations: means those operations where livestock or other agricultural animals are raised, or crops are grown, for commercial purposes, not to include those operations set forth within section 25-3801(2), Idaho Code. See Idaho Code 25-3803
  • Agritourism activity: means any activity carried out on a farm or ranch that allows members of the general public, for recreational, entertainment or educational purposes, to view or enjoy rural activities including, but not limited to, farming, ranching, historic, cultural, on-site educational programs, recreational farming programs that may include on-site hospitality services, guided and self-guided tours, bed and breakfast accommodations, petting zoos, farm festivals, corn mazes, harvest-your-own operations, hayrides, barn parties, horseback riding, fee fishing and camping. See Idaho Code 28-2-401
  • Agritourism professional: means any person who is engaged in the business of providing one (1) or more agritourism activities, whether or not for compensation. See Idaho Code 28-2-401
  • Alcoholic beverages: means such beverages as defined in section 23-105, Idaho Code, as alcoholic liquor, including alcohol, spirits, wine or any combination thereof, and beverages defined in section 23-1001, Idaho Code, as beer. See Idaho Code 23-1401
  • Allegation: something that someone says happened.
  • ambulance service district: means a political subdivision formed to provide ambulance transport, emergency medical services as defined in section 56-1012, Idaho Code, community health emergency medical services as defined in section 56-1012, Idaho Code, and/or other activities necessary to meet the community health needs of the district. See Idaho Code 31-3908
  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • Ancillary business: means a business owned by a distributor, by a substantial stockholder of a distributor, or by a substantial partner of a distributor, the primary business of which is directly related to the transporting, storing or marketing of the supplier’s products. See Idaho Code 23-1102
  • Animal: means any vertebrate member of the animal kingdom, except man. See Idaho Code 25-3502
  • Animal care and control agency: means any agency incorporated under the laws of this state to which a county or municipality has conferred authority to exercise the powers and duties set forth in this chapter based upon the agency’s ability to fulfill the purposes of this chapter. See Idaho Code 25-3502
  • Annual percentage rate: The cost of credit at a yearly rate. It is calculated in a standard way, taking the average compound interest rate over the term of the loan so borrowers can compare loans. Lenders are required by law to disclose a card account's APR. Source: FDIC
  • Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
  • Apparent owner: means the person whose name appears on the records of the holder as the person entitled to property held, issued, or owing by the holder. See Idaho Code 28-46-101
  • Applicant: means an out-of-state financial institution holding company which has submitted an application under section 26-2605, Idaho Code. See Idaho Code 26-2603
  • Applicant: means a person filing an application for a license under the provisions of this chapter. See Idaho Code 26-2902
  • Applicant: means the individual and all others in the household who are requesting nonmedical assistance and who submit a county application. See Idaho Code 31-3403
  • Applicant: means any person who is requesting financial assistance under this chapter. See Idaho Code 31-3502
  • Application: means the combined application for state and county medical assistance pursuant to sections 31-3504 and 31-3503E, Idaho Code. See Idaho Code 31-3502
  • Appraisal: A determination of property value.
  • Approved feedlot: means a livestock feedlot, inspected and approved by the department, for finish feeding cattle or bison of unknown disease, test or vaccination status. See Idaho Code 25-239
  • Arrears: means child or spousal support that is due, owing and unpaid pursuant to a support order. See Idaho Code 32-1602
  • Art dealer: means a person engaged in the business of selling works of fine art, other than a person exclusively engaged in the business of selling goods at public auction. See Idaho Code 28-11-101
  • Artist: means a person who creates a work of fine art or, if the person is deceased, the person's heir, devisee, or personal representative. See Idaho Code 28-11-101
  • Asset: means cash or cash value in or of a demand deposit account, checking or negotiable withdrawal order account, savings account, share account, share draft account, time deposit account or money market mutual fund account; and/or negotiable instruments including stocks and bonds, annuities, investment accounts or funds, and the cash value of insurance. See Idaho Code 32-1602
  • Asset withholding order: means an administrative order issued by the department of health and welfare to a financial institution requiring the freezing and surrender of an asset in which an obligor has an interest. See Idaho Code 32-1602
  • Assets: means property rights including, but not limited to, personal, real, tangible and intangible property. See Idaho Code 31-3403
  • Attorney general: means the chief legal officer of this state. See Idaho Code 28-46-101
  • Attorney-at-law: A person who is legally qualified and licensed to practice law, and to represent and act for clients in legal proceedings.
  • Authorized chartering entity: means any of the following:

  • Authorized representative: means an entity designated by the licensee under the provisions of this chapter to sell or issue payment instruments or engage in the business of transmitting money on behalf of a licensee. See Idaho Code 26-2902
  • Authorized representative: means the applicant’s guardian or appointed attorney-in-fact. See Idaho Code 31-3403
  • Bailee: means a person that by a warehouse receipt, bill of lading, or other document of title acknowledges possession of goods and contracts to deliver them. See Idaho Code 28-7-102
  • Ballot: means any material used or the voting surface of a direct recording electronic system on which votes are cast for offices, candidates and measures. See Idaho Code 34-2401
  • Ballot card: means the tabulating card or cards of any size upon which the voter records his vote. See Idaho Code 34-2401
  • Bank: means :

  • Bank: shall mean any bank chartered under this act. See Idaho Code 26-501
  • Bank holding company: shall mean any company:

  • Banking day: means the part of a day on which a bank is open to the public for carrying on substantially all of its banking functions;
  • Idaho Code 28-4-104
  • Baseline: Projection of the receipts, outlays, and other budget amounts that would ensue in the future without any change in existing policy. Baseline projections are used to gauge the extent to which proposed legislation, if enacted into law, would alter current spending and revenue levels.
  • Basic consolidated emergency system: means consolidated emergency systems that are not enhanced. See Idaho Code 31-4802
  • Beef cattle: means slaughter and feeder cattle or dairy heifers that are kept on or contiguous to the animal feeding operation and are owned or controlled by the animal feeding operation. See Idaho Code 22-4904
  • Beef cattle animal feeding operation: means an animal feeding operation which confines the number of slaughter and feeder cattle or dairy heifers as set forth in 40 CFR 122. See Idaho Code 22-4904
  • beer: means any beverage obtained by the alcoholic fermentation of an infusion or decoction of barley, malt and/or other ingredients in drinkable water. See Idaho Code 23-1001
  • Beneficiary: means a person named in a trust account as one for whom a party to the account is named as trustee;
  • Idaho Code 15-6-101
  • Bequest: Property gifted by will.
  • Best management practices: means practices, techniques or measures which are determined to be reasonable precautions, are a cost-effective and practicable means of preventing or reducing pollutants from point sources or nonpoint sources to a level compatible with environmental goals, including water quality goals and standards for waters of the state. See Idaho Code 22-4904
  • Blind or visually impaired: means impacted by an impairment in vision that, even with correction, adversely affects a child’s educational performance. See Idaho Code 33-3402
  • Board: means the Idaho wolf depredation control board;
  • Idaho Code 22-5303
  • Board: means a board of county commissioners. See Idaho Code 31-3403
  • Board: means the board of the catastrophic health care cost program, as established in section 31-3517, Idaho Code. See Idaho Code 31-3502
  • board: means the Idaho horse board. See Idaho Code 25-2503
  • Board: means the state board of education. See Idaho Code 33-1303
  • Board: means the state brand board created in chapter 11, title 25, Idaho Code. See Idaho Code 25-3301
  • board: means the board of directors of the Idaho bureau of educational services for the deaf and the blind as such board is established in section 33-3404, Idaho Code. See Idaho Code 33-3402
  • Board: means the state board of education. See Idaho Code 33-4403
  • Board: means the state college savings program board created in section 33-5402, Idaho Code. See Idaho Code 33-5401
  • board: means the board of directors of the Idaho digital learning academy as such board is created in section 33-5503, Idaho Code. See Idaho Code 33-5505
  • Board: means the governing body of a school district or public charter school. See Idaho Code 33-5802
  • Bond equivalent: means a letter of credit or trust fund agreement that complies with the packers and stockyards act of 1921, as amended, and regulations promulgated thereunder. See Idaho Code 25-3301
  • Brand: means one, either, or both of the following:

  • brand board: means the state brand board. See Idaho Code 25-2503
  • Brand inspection certificate: means a certificate on a form adopted by the state brand board, listing the animals for which the certificate is issued, describing the animals listed thereon, listing the name and address of the owner of the livestock, the name and address of the new owner, the listing of the place of origin and of destination of such transportation, and such other information as may be required by the state brand board.   • Brand inspector: means the state brand inspector, any authorized deputy or assistant brand inspector, or any other person authorized by the laws of the state of Idaho to make brand inspections. See Idaho Code 25-1101
  • brand name: means any word, name, symbol or device, or any combination thereof, identifying the commercial feed of a distributor or registrant and distinguishing it from that of others. See Idaho Code 25-2703
  • brewer: means a person licensed to manufacture beer. See Idaho Code 23-1001
  • Brewery: means a place, premises or establishment for the manufacture, bottling or canning of beer. See Idaho Code 23-902
  • Broker-dealer: means a person engaged in the business of effecting transactions in securities for the account of others or for the person's own account. See Idaho Code 30-14-102
  • Budget resolution: Legislation in the form of a concurrent resolution setting forth the budget. The budget resolution establishes various budget totals, divides spending totals into functional categories (e.g., transportation), and may include reconciliation instructions to designated committees.
  • Bureau: means the Idaho bureau of educational services for the deaf and the blind. See Idaho Code 33-1303
  • Bureau: means the Idaho bureau of educational services for the deaf and the blind as created in section 33-3403, Idaho Code. See Idaho Code 33-3402
  • Business association: means a nonpublic corporation, limited liability company, joint stock company, investment company, business trust, partnership, or association for business purposes of two (2) or more individuals, whether or not for profit, including, but not limited to, a banking organization, financial organization, insurance company, or utility. See Idaho Code 28-46-101
  • Buyer: means a person who buys or contracts to buy goods. See Idaho Code 28-2-103
  • Buying station: means a livestock facility where cattle are gathered to be shipped directly to slaughter within seven (7) days of arrival at the buying station. See Idaho Code 25-239
  • CAFO: means an AFO that is defined as a large poultry CAFO or as a medium poultry CAFO by the terms of this chapter, or that is designated as a CAFO in accordance with section 25-4011, Idaho Code. See Idaho Code 25-4002
  • Capital: means the shares of a credit union. See Idaho Code 26-2104
  • Career ladder: means the compensation table used for determining the allocations districts receive for instructional staff and pupil service staff based on specific performance criteria and is made up of a residency compensation rung and a professional compensation rung. See Idaho Code 33-1001
  • career technical education: means secondary, postsecondary and adult courses, programs, training and services administered by the division of career technical education for occupations or careers that require other than a baccalaureate, master’s or doctoral degree. See Idaho Code 33-2202
  • Career technical regional public charter school: means a public charter secondary school authorized under this chapter to provide programs in career technical education which meet the standards and qualifications established by the division of career technical education. See Idaho Code 33-5202A
  • Carrier: means a person that issues a bill of lading. See Idaho Code 28-7-102
  • Case management: means coordination of services to help meet a patient’s health care needs, usually when the patient has a condition that requires multiple services. See Idaho Code 31-3502
  • Certificate of approval: means a license issued to a person whose business is located outside of the state of Idaho, who sells beer to wholesalers located within the state of Idaho. See Idaho Code 23-1001
  • Chambers: A judge's office.
  • Charter: means the grant of authority approved by the authorized chartering entity to the board of directors of the public charter school. See Idaho Code 33-5202A
  • Charter holder: means the public charter school’s board of directors to which a charter is granted pursuant chapter 52, title 33, Idaho Code. See Idaho Code 33-5202A
  • check: refers to a check or the electronic equivalent of a check, including an authorization given by a borrower to a creditor to withdraw an agreed upon amount from any account held by the borrower. See Idaho Code 28-46-401
  • Chief judge: The judge who has primary responsibility for the administration of a court but also decides cases; chief judges are determined by seniority.
  • Child support: means the obligation, pursuant to a support order, to provide for the needs of a child, including food, clothing, shelter, education, day care and health care. See Idaho Code 32-1602
  • Child support: means a legally enforceable obligation assessed against an individual for the support of a child which shall include medical care, including health insurance premiums for the child, and any amount owing under an order for support during a period in which public assistance was expended. See Idaho Code 28-4-628
  • City library: means a library established by a city ordinance and operating under the provisions of chapter 26, title 33, Idaho Code. See Idaho Code 33-2702
  • Claimant: means a homeowner or association that asserts a claim against a construction professional concerning a defect in the construction of a residence or in the substantial remodel of a residence. See Idaho Code 28-2-311
  • Clandestine drug laboratory: means the areas where controlled substances or their immediate precursors, as those terms are defined in section 37-2701, Idaho Code, have been, or were attempted to be, manufactured, processed, cooked, disposed of or stored, and all proximate areas that are likely to be contaminated as a result of such manufacturing, processing, cooking, disposing or storing.   • Clearing house: means an association of banks or other payors regularly clearing items;

  • Clerk: means the clerk of a board of county commissioners or his designee. See Idaho Code 31-3403
  • Clerk: means the clerk of the respective counties or his or her designee. See Idaho Code 31-3502
  • Clerk of court: An officer appointed by the court to work with the chief judge in overseeing the court's administration, especially to assist in managing the flow of cases through the court and to maintain court records.
  • Club: includes any of the following organizations where the sale of spirituous liquor for consumption on the premises is made to members and to bona fide guests of members only:

  • Co-owner: means a person having withdrawal rights on a multiple party account. See Idaho Code 32-1602
  • commercial feed: means all materials or combination of materials which are distributed or intended for distribution for use as feed, or for mixing in feed for poultry and animals other than man except:

  • Commission: means the Idaho dairy products commission;
  • Idaho Code 25-3103
  • Commission: means the Idaho state tax commission. See Idaho Code 28-45-104
  • Commissioners: means the board of commissioners of each county within a district. See Idaho Code 31-4902
  • Companion animal: means those animals solely kept as pets and not used as production animals, as defined in this section, including, but not limited to, domestic dogs, domestic cats, rabbits, companion birds, and other animals. See Idaho Code 25-3502
  • Company: shall mean any corporation, business trust, association, or similar organization but shall not include:

  • Compensation rung: means the rung on the career ladder that corresponds with the compensation level performance criteria. See Idaho Code 33-1001
  • Completed application: shall include at a minimum the cover sheet requesting services, applicant information including diagnosis and requests for services and signatures, personal and financial information of the applicant and obligated person or persons, patient rights and responsibilities, releases and all other signatures required in the application. See Idaho Code 31-3502
  • Concurrent resolution: A legislative measure, designated "S. Con. Res." and numbered consecutively upon introduction, generally employed to address the sentiments of both chambers, to deal with issues or matters affecting both houses, such as a concurrent budget resolution, or to create a temporary joint committee. Concurrent resolutions are not submitted to the President/Governor and thus do not have the force of law.
  • Consignee: means a person named in a bill of lading to which or to whose order the bill promises delivery. See Idaho Code 28-7-102
  • Consignment: means that no title to, estate in or right to possession of fine art superior to that of the consignor vests in the consignee, notwithstanding the consignee's power or authority to transfer and convey to a third person all of the right, title and interest of the consignor in and to the fine art. See Idaho Code 28-11-101
  • Consignor: means a person named in a bill of lading as the person from which the goods have been received for shipment. See Idaho Code 28-7-102
  • Consolidated emergency communications system: means facilities, equipment and dispatching services directly related to establishing, maintaining, or enhancing a 911 emergency communications service. See Idaho Code 31-4802
  • Construction professional: means any person with a right to lien pursuant to section 45-501, Idaho Code, an architect, subdivision owner or developer, builder, contractor, subcontractor, engineer or inspector, performing or furnishing the design, supervision, inspection, construction or observation of the construction of any improvement to residential real property, whether operating as a sole proprietor, partnership, corporation, limited liability company or other business entity. See Idaho Code 28-2-311
  • Consumer lease: means a lease that a lessor regularly engaged in the business of leasing or selling makes to a lessee who is an individual and who takes under the lease primarily for a personal, family or household purpose, if the total payments to be made under the lease contract, excluding payments for options to renew or buy, do not exceed twenty-five thousand dollars ($25,000). See Idaho Code 28-12-103
  • Continuance: Putting off of a hearing ot trial until a later time.
  • Continuing care: means the furnishing to an individual, other than an individual related by blood, marriage, or adoption to the person furnishing the care, of lodging together with nursing services, medical services, or other health related services, pursuant to an agreement requiring an entrance fee. See Idaho Code 26-3703
  • Continuing garnishment: means a garnishment of wages of the judgment debtor that continues, subject to the limitations found in section 11-705, Idaho Code, until the debt is satisfied. See Idaho Code 28-36-111
  • Contract for sale: includes both a present sale of goods and a contract to sell goods at a future time. See Idaho Code 28-2-106
  • Control: means ownership of, or the power to vote, twenty-five percent (25%) or more of the outstanding voting securities of a licensee or controlling person. See Idaho Code 26-2902
  • Controlling person: means any person in control of a licensee. See Idaho Code 26-2902
  • Convention: means a formal meeting of members, representatives, or delegates, as of a political party, fraternal society, profession or industry. See Idaho Code 23-902
  • County commissioners: means the board of county commissioners in their respective counties. See Idaho Code 31-3502
  • County hospital: means any county approved institution or facility for the care of sick persons. See Idaho Code 31-3502
  • Course: means a course of instruction or a program of instruction. See Idaho Code 33-5102
  • Court reporter: A person who makes a word-for-word record of what is said in court and produces a transcript of the proceedings upon request.
  • Credit report: A detailed report of an individual's credit history prepared by a credit bureau and used by a lender in determining a loan applicant's creditworthiness. Source: OCC
  • Credit Score: A number, roughly between 300 and 800, that measures an individual's credit worthiness. The most well-known type of credit score is the FICO score. This score represents the answer from a mathematical formula that assigns numerical values to various pieces of information in your credit report. Source: OCC
  • Credit union: means a cooperative nonprofit corporation chartered under the provisions of this chapter. See Idaho Code 26-2104
  • Credit union service corporation: means a corporation organized to perform credit union services for two (2) or more credit unions, each of which owns part of the capital stock of such corporations, and which are subject to examination by either the department of finance of the state of Idaho or a federal supervisory agency. See Idaho Code 26-2104
  • Credit union services: means services such as draft and deposit sorting and posting, computation and posting of interest and other credits and charges, preparation and mailing of drafts, statements, notices, and similar items, or any other clerical, bookkeeping, accounting, statistical, or similar functions performed for a credit union. See Idaho Code 26-2104
  • Cross examine: Questioning of a witness by the attorney for the other side.
  • cruelty: shall mean any or all of the following:

  • Custodian: means any person who keeps or harbors an animal, has an animal in his care or acts as caretaker of an animal. See Idaho Code 25-3502
  • Customer: means any person having an account with a bank or for whom a bank has agreed to collect items, including a bank that maintains an account at another bank;

  • customer-formula feed: means commercial feed which consists of a mixture of commercial feeds and/or feed ingredients each batch of which is manufactured according to the specific instructions of the final purchaser, end user or consumer. See Idaho Code 25-2703
  • Deaf: means a person who is not able to process information aurally and whose primary means of communication is visual. See Idaho Code 33-1303
  • Deaf or hard of hearing: means impacted by an impairment in hearing, whether permanent or fluctuating, that adversely affects a child’s educational performance, or impacted by a hearing impairment that is so severe that the child is impaired in processing linguistic information through hearing, with or without amplification that adversely affects a child’s educational performance.   • Deaf-blind: means a person who is deaf or hard of hearing and who also has significant visual impairment or is legally blind. See Idaho Code 33-1303
  • dealer: means a person licensed to import beer into this state for sale to a wholesaler. See Idaho Code 23-1001
  • Dealer: means one who handles, ships, buys, processes, and sells dairy products, or who acts as sales or purchasing agent, broker, or factor of dairy products;
  • Idaho Code 25-3103
  • Debit card transaction: means the purchase of either goods or services, or both, whereby payment is made through the means of a point of sale or other payment system maintained by the college or university which results in a charge to a credit balance maintained by a registered student or a member of its faculty or staff with the college or university business office.   • Decedent: means a deceased individual. See Idaho Code 28-45-104
  • Delinquency: means unpaid support for a minor child or spouse which has accrued under an order. See Idaho Code 28-4-628
  • Delivery order: means a record that contains an order to deliver goods directed to a warehouse, carrier, or other person that in the ordinary course of business issues warehouse receipts or bills of lading. See Idaho Code 28-7-102

  • Division: means the division of animal industries of the Idaho state department of agriculture. See Idaho Code 25-3502
  • Docket: A log containing brief entries of court proceedings.
  • Documentary draft: means a draft to be presented for acceptance or payment if specified documents, certificated securities (section 28-8-102) or instructions for uncertificated securities (section 28-8-102), or other certificates, statements, or the like are to be received by the drawee or other payor before acceptance or payment of the draft;

  • Domestic septage: means either liquid or solid material removed from a septic tank, cesspool, portable toilet, type III marine sanitation device, or similar treatment works that receive only domestic sewage. See Idaho Code 31-4902

  • E-rate: means the schools and libraries program of the universal service fund that is administered by the universal service administrative company under the direction of the federal communications commission. See Idaho Code 33-5602
  • E-rate eligible entities: means Idaho public schools grades K through 12, the Idaho digital learning academy, the Idaho department of juvenile corrections education programs, the school for the deaf and the blind and the Idaho public libraries. See Idaho Code 33-5602
  • Earnings: means compensation paid or payable for personal services, whether denominated as wages, salary, commission, bonus or otherwise, and includes periodic payments pursuant to a pension or retirement program. See Idaho Code 28-36-111
  • Educational interpreter: means a person employed in the Idaho public schools, kindergarten through grade twelve (12), to provide interpreting services to students who are deaf, hard of hearing or deaf-blind. See Idaho Code 33-1303
  • Educational interpreter performance assessment: means a statistically valid and reliable assessment tool administered by the boys town national research hospital or its successor organization. See Idaho Code 33-1303
  • Educational services provider: means a nonprofit or for-profit entity that contracts with a public charter school to provide educational services and resources including administrative support and educational design, implementation or management. See Idaho Code 33-5202A
  • Election: means all state, county, city, district and other political subdivision elections including bond issue elections. See Idaho Code 34-2401
  • Eligible institution: means a public or private postsecondary educational institution accredited by an organization recognized by the state board of education. See Idaho Code 33-5102
  • Embezzlement: In most states, embezzlement is defined as theft/larceny of assets (money or property) by a person in a position of trust or responsibility over those assets. Embezzlement typically occurs in the employment and corporate settings. Source: OCC
  • Emergency: means any circumstance demanding immediate action. See Idaho Code 31-3403
  • Emergency: means the occurrence or imminent threat of a condition threatening life or property which requires emergency assistance. See Idaho Code 28-2-324
  • Emergency communications fee: means the fee provided for in section 31-4803, Idaho Code. See Idaho Code 31-4802
  • Emergency responder: means a person employed by or who is a bona fide member of a governmental entity of another state of the United States including, but not limited to, a legally organized law enforcement agency, a legally organized fire department or a licensed emergency medical service provider, and whose primary duty is to serve or protect the safety or life of any person or to protect property.   • Employee: means a person who performs a service for wages or other remuneration. See Idaho Code 28-1-307
  • Employer: includes an agent of an employer. See Idaho Code 28-1-307
  • Endangered species: means those species listed as endangered pursuant to 16 U. See Idaho Code 36-2401
  • Engaged in sport shooting activities: means entering and exiting a sport shooting range, preparing to shoot, waiting to shoot, shooting and assisting another person in shooting. See Idaho Code 28-2-322
  • Enhanced consolidated emergency system: means consolidated emergency systems that provide enhanced wireless 911 service and include, but are not limited to, the technological capability to provide call back numbers, cell site locations, and the location of calls by latitude and longitude and made through the systems of wireless carriers. See Idaho Code 31-4802
  • Entitlement: A Federal program or provision of law that requires payments to any person or unit of government that meets the eligibility criteria established by law. Entitlements constitute a binding obligation on the part of the Federal Government, and eligible recipients have legal recourse if the obligation is not fulfilled. Social Security and veterans' compensation and pensions are examples of entitlement programs.
  • Entrance fee: means an initial or deferred transfer to a provider of a sum of money or other property made or promised to be made as full or partial consideration for acceptance of a specified individual as a resident in a facility. See Idaho Code 26-3703
  • Equine: means a horse, pony, mule, donkey or hinny. See Idaho Code 28-1-202
  • Equine activity: means :

  • Equine activity sponsor: means an individual, group or club, partnership or corporation, whether or not the sponsor is operating for profit or nonprofit, which sponsors, organizes or provides the facilities for an equine activity including, but not limited to, pony clubs, 4-H clubs, hunt clubs, riding clubs, school and college sponsored classes and programs, therapeutic riding programs, and operators, instructors and promoters of equine facilities including, but not limited to, stables, clubhouses, ponyride strings, fairs and arenas at which the activity is held.   • Equine professional: means a person engaged for compensation in:

  • Escheat: Reversion of real or personal property to the state when 1) a person dies without leaving a will and has no heirs, or 2) when the property (such as a bank account) has been inactive for a certain period of time. Source: OCC
  • Escrow: means any transaction in which any person, for the purpose of effecting the sale, transfer, encumbrance, or lease of real or personal property to another person, delivers any written instrument, money, evidence of title to real or personal property, or other thing of value to a third person to be held by that third person until the happening of a specified event or the performance of a prescribed condition, when the instrument, money, evidence of title or thing of value is then to be delivered by the third person to a grantee, grantor, promisee, promisor, obligee, obligor, bailee, bailor, or any agent or employee of any of the latter, pursuant to written instructions.   • Escrow agency: means any person engaged in the business of accepting or receiving escrows for deposit or delivery by any means, including over the internet, or by any other electronic means. See Idaho Code 30-902
  • Escrow agent: means any person engaged in the business of accepting or receiving escrows for deposit or delivery on behalf of an escrow agency. See Idaho Code 30-902
  • Ex officio: Literally, by virtue of one's office.
  • Executive officer: means the licensee’s president, chief executive officer, treasurer, chief financial officer and any other person who performs similar functions. See Idaho Code 26-2902
  • Executive session: A portion of the Senate's daily session in which it considers executive business.
  • Extradition: The formal process of delivering an accused or convicted person from authorities in one state to authorities in another state.
  • facilities: means all equipment and other property, including electrical cogeneration equipment, deemed necessary by the district board for the operation of a solid waste disposal and/or resource recovery system or the operation of domestic septage receiving stations, domestic septage treatment processes and domestic septage disposal methods.   • Facility: means the place or places in which a person undertakes to provide continuing care to an individual. See Idaho Code 26-3703
  • Failure: means the date that one (1) or more of the following events occurred, as determined by the director:

  • Federal estate tax return: means any form or other document which establishes, changes or amends a federal estate tax amount. See Idaho Code 28-45-104
  • Federal international bank institutions: means a branch, agency, or representative office of an international banking corporation established and operating under the federal international banking act of 1978, 12 U. See Idaho Code 26-1702
  • Federal supervisory agency: means the National Credit Union Administration. See Idaho Code 26-2104
  • Fee simple: Absolute title to property with no limitations or restrictions regarding the person who may inherit it.
  • feed ingredient: means each of the constituent materials making up a commercial feed. See Idaho Code 25-2703
  • Festival: means a period or program of festive activities, cultural events or entertainment lasting three (3) or more consecutive days. See Idaho Code 23-902
  • Filing: means the receipt under this chapter of a record by the administrator or a designee of the administrator. See Idaho Code 30-14-102

  • Fine art: means a painting, sculpture, drawing, work of graphic art, including an etching, lithograph, signed limited edition offset print, silk screen, or a work of graphic art of like nature; a work of calligraphy, photographs, original works in ceramics, wood, metals, glass, plastic, wax, stone or leather or a work in mixed media, including a collage, assemblage, or any combination of the art media mentioned in this subsection.   • Firewood gatherer: means a person who enters onto forest land with or without the consent of the owner of the forest land or by payment of a fee in order to gather or cut wood for use as firewood. See Idaho Code 26-31-317
  • Fixed Rate: Having a "fixed" rate means that the APR doesn't change based on fluctuations of some external rate (such as the "Prime Rate"). In other words, a fixed rate is a rate that is not a variable rate. A fixed APR can change over time, in several circumstances:
    • You are late making a payment or commit some other default, triggering an increase to a penalty rate
    • The bank changes the terms of your account and you do not reject the change.
    • The rate expires (if the rate was fixed for only a certain period of time).
  • Forbearance: A means of handling a delinquent loan. A
  • Foreclosure: A legal process in which property that is collateral or security for a loan may be sold to help repay the loan when the loan is in default. Source: OCC

  • Forest land: means any privately owned land being held and used for the continuous purpose of growing and harvesting trees of a marketable species. See Idaho Code 26-31-317

  • Gaming: means any and all gambling or games of chance defined in chapters 38 and 49, title 18, Idaho Code, or any section or sections thereof, whether those games are licensed or unlicensed. See Idaho Code 23-902
  • Garnishee: means a person or institution that is indebted to or is in possession of property, money or credits of a debtor whose property has been subjected to garnishment. See Idaho Code 28-36-111
  • Garnishment: means a judicial proceeding in which a creditor or potential creditor asks the court to order a third party who is indebted to, or is in possession of, property, money or credits of the debtor to turn over to the creditor any of the debtor’s property, money or credits held by that third party.   • Germane: On the subject of the pending bill or other business; a strict standard of relevance.
  • Gleaner: means a person who harvests for free distribution perishable food that has been donated by the owner. See Idaho Code 26-31-305
  • Good faith: means honesty in fact in the conduct or transaction involved and the observance of reasonable commercial standards of fair dealing in the trade, as such term and standards are defined in, and interpreted pursuant to, the uniform commercial code, title 28, Idaho Code.   • Goods: means all things that are treated as movable for the purposes of a contract for storage or transportation. See Idaho Code 28-7-102

  • Household: means a collective body of persons consisting of spouses or parents and their children who reside in the same residence; or all other persons who by choice or necessity are mutually dependent upon each other for basic necessities and who reside in the same residence.   • Housing finance agency: means any entity that is:

  • Idaho digital learning academy: means an online educational program organized as a fully accredited school with statewide capabilities for delivering accredited courses to Idaho resident students at no cost to the student unless the student enrolls in additional courses beyond full-time enrollment.   • Idaho financial institution holding company: means a financial institution holding company whose principal place of business is, and whose operations are principally conducted in, this state. See Idaho Code 26-2603
  • Idaho school for the deaf and the blind: means the campus program used to provide residential and day campus instruction and services to deaf or hard of hearing and/or blind or visually impaired students. See Idaho Code 33-3402
  • Impeachment: (1) The process of calling something into question, as in "impeaching the testimony of a witness." (2) The constitutional process whereby the House of Representatives may "impeach" (accuse of misconduct) high officers of the federal government for trial in the Senate.
  • Importer: means a person to whom a wine importer’s license has been issued. See Idaho Code 23-1303
  • In danger of failing: means a financial institution is in danger of failing if: (i) the financial institution is not likely to be able to meet the demands of its depositors or pay its obligations in the normal course and there is no reasonable prospect for it to do so without federal or other governmental assistance; or (ii) the financial institution has incurred or is likely to incur losses that will deplete all or substantially all of its capital and there is no reasonable prospect for replenishing the financial institutions’ capital without federal or other governmental assistance.   • Income: means any form of payment to an individual, regardless of source, including, but not limited to, wages, salary, commission, compensation as an independent contractor, worker’s compensation, disability, veteran’s annuity and retirement benefits, and any other payments made by any person, private entity, federal or state government, any unit of local government, school district or any entity created by a public act. See Idaho Code 28-4-628
  • Indictment: The formal charge issued by a grand jury stating that there is enough evidence that the defendant committed the crime to justify having a trial; it is used primarily for felonies.
  • Indigent: means any applicant who does not have resources available from whatever source which shall be sufficient to enable the applicant to provide nonmedical assistance or a portion thereof. See Idaho Code 31-3403
  • Information release: means the document authorizing release of confidential information. See Idaho Code 31-3403
  • Innovation school: means a public school participating in the local innovation school act. See Idaho Code 33-5802
  • Innovation school agreement: means a written agreement between the innovation school team and the board establishing the innovation school. See Idaho Code 33-5802
  • Innovation school team: means the combination of individuals responsible for the operations of an innovation school. See Idaho Code 33-5802
  • Institutional investor: means any of the following, whether acting for itself or for others in a fiduciary capacity:

  • Insurance company: means an association, corporation, fraternal or mutual benefit organization, whether or not for profit, which is engaged in providing insurance coverage, including accident, burial, casualty, credit life, contract performance, dental, fidelity, fire, health, hospitalization, illness, life, including endowments and annuities, malpractice, marine, mortgage, surety, and wage protection insurance.   • Insurance company: means a company organized as an insurance company whose primary business is writing insurance or reinsuring risks underwritten by insurance companies and which is subject to supervision by the insurance commissioner or a similar official or agency of a state. See Idaho Code 30-14-102
  • Insured: means insured as to payment of all principal and all interest. See Idaho Code 30-14-102
  • Intangible property: Property that has no intrinsic value, but is merely the evidence of value such as stock certificates, bonds, and promissory notes.

  • Interest rate: The amount paid by a borrower to a lender in exchange for the use of the lender's money for a certain period of time. Interest is paid on loans or on debt instruments, such as notes or bonds, either at regular intervals or as part of a lump sum payment when the issue matures. Source: OCC
  • International bank agency: means a business or any part of a banking business conducted in this state or through an office located in this state, other than a federal international bank institution, which exercises powers as set forth in section 26-1709, Idaho Code, on behalf of an international banking corporation.   • International bank branch: means a business or any part of a banking business conducted in this state, or through an office located in this state, other than a federal international bank institution, which exercises powers as set forth in section 26-1709, Idaho Code, on behalf of an international banking corporation.   • International banking corporation: means a banking corporation organized and licensed under the laws of a foreign country or a political subdivision of a foreign country. See Idaho Code 26-1702

  • International representative office: means a business location of a representative of an international banking corporation other than a federal international bank institution, established to act in a liaison capacity with existing and potential customers of the international banking corporation and to generate new loans and other activities for the international banking corporation that is operating outside the state.   • Interoperability: means the ability of public safety service and support providers, law enforcement, public utilities, transportation and others to communicate when necessary with staff from other responding agencies, and to exchange voice, video, and data on demand, in real time, and when authorized. See Idaho Code 31-4802
  • Interoperable public safety communications and data systems: means facilities, equipment, networks, services, software and infrastructure directly related to establishing, maintaining or enhancing systems to exchange voice, video or other public safety data, to include future technology advancements. See Idaho Code 31-4802
  • Interpreter education program: means a postsecondary degree program of at least two (2) years in duration that is accredited by the state board of education or an equivalent program accredited by another state, district or territory or by a professional accreditation body. See Idaho Code 33-1303
  • Interpreting: means the process of providing accessible communication between and among persons who are deaf, hard of hearing or deaf-blind, and those who are hearing. See Idaho Code 33-1303
  • Interrogatories: Written questions asked by one party of an opposing party, who must answer them in writing under oath; a discovery device in a lawsuit.
  • Interstate credit union: means a credit union chartered under the provisions of this chapter or under the authority of the laws of another state and operating both in Idaho and in one (1) or more other states. See Idaho Code 26-2104
  • Invest: means any advance of funds to a credit union service corporation, whether by the purchase of stock, the making of a loan, or otherwise, except a payment for rent earned, goods sold and delivered, or services rendered prior to the making of such payment. See Idaho Code 26-2104
  • Investment adviser: means a person that, for compensation, engages in the business of advising others, either directly or through publications or writings, as to the value of securities or the advisability of investing in, purchasing or selling securities or that, for compensation and as a part of a regular business, issues or promulgates analyses or reports concerning securities. See Idaho Code 30-14-102
  • Investment adviser representative: means an individual employed by or associated with an investment adviser or federal covered investment adviser who makes any recommendations or otherwise gives investment advice regarding securities, manages accounts or portfolios of clients, determines which recommendation or advice regarding securities should be given, provides investment advice or holds herself or himself out as providing investment advice, receives compensation to solicit, offer, or negotiate for the sale of or for selling investment advice, or supervises employees who perform any of the foregoing.   • Irrevocable trust: A trust arrangement that cannot be revoked, rescinded, or repealed by the grantor.
  • Issuer: means a bailee that issues a document of title or, in the case of an unaccepted delivery order, the person that orders the possessor of goods to deliver. See Idaho Code 28-7-102
  • Issuer: means a person that issues or proposes to issue a security, subject to the following:

  • Item: means an instrument or a promise or order to pay money handled by a bank for collection or payment. See Idaho Code 28-4-104
  • Joint account: means an account payable on request to one (1) or more of two (2) or more parties whether or not mention is made of any right of survivorship;

  • Joint committee: Committees including membership from both houses of teh legislature. Joint committees are usually established with narrow jurisdictions and normally lack authority to report legislation.
  • Joint meeting: An occasion, often ceremonial, when the House and Senate each adopt a unanimous consent agreement
  • Joint tenancy: A form of property ownership in which two or more parties hold an undivided interest in the same property that was conveyed under the same instrument at the same time. A joint tenant can sell his (her) interest but not dispose of it by will. Upon the death of a joint tenant, his (her) undivided interest is distributed among the surviving joint tenants.
  • Juror: A person who is on the jury.
  • Key shareholder: means any person, or group of persons acting in concert, who is the owner of twenty-five percent (25%) or more of any class of an applicant’s stock. See Idaho Code 26-2902

  • Land application: means the spreading on, or incorporation of, animal waste into the soil mantle primarily for beneficial purposes. See Idaho Code 25-4002
  • Last known address: means a description of the location of the apparent owner sufficient for the purpose of the delivery of mail. See Idaho Code 28-46-101
  • Law enforcement agency: means any policing agency of the state or of any political subdivision of the state. See Idaho Code 28-2-316
  • Lease: means a transfer of the right to possession and use of goods for a term in return for consideration, but a sale, including a sale on approval or a sale or return, or retention or creation of a security interest is not a lease. See Idaho Code 28-12-103
  • Lease agreement: means the bargain, with respect to the lease, of the lessor and the lessee in fact as found in their language or by implication from other circumstances including course of dealing or usage of trade or course of performance as provided in this chapter. See Idaho Code 28-12-103
  • Lease contract: means the total legal obligation that results from the lease agreement as affected by this chapter and any other applicable rules of law. See Idaho Code 28-12-103
  • Leasehold interest: means the interest of the lessor or the lessee under a lease contract. See Idaho Code 28-12-103
  • Legal drinking age: means the age when a person is legally allowed to purchase or consume any alcoholic beverage, as provided in section 23-615, Idaho Code. See Idaho Code 23-1401

  • Liquid waste system: means those wastewater storage and containment facilities and associated waste collection and conveyance systems where water is used as the primary carrier of manure and manure is added to the wastewater storage and containment facilities on a regular basis including the final distribution system.   • Liquor: means all kinds of liquor sold by and in a state liquor store of the state of Idaho. See Idaho Code 23-902
  • Livestock: means any cattle, horses, mules or asses. See Idaho Code 25-1101

  • Livestock dealer: means any person who buys, receives or assembles livestock for his own account for resale within twenty (20) days from the date of purchase, or for the account of another person. See Idaho Code 25-3301

  • Loan modification: means an adjustment or compromise of an existing residential mortgage loan. See Idaho Code 26-31-201
  • Loan modification activities: means for compensation or gain, or in the expectation of compensation or gain, engaging in or offering to engage in effecting loan modifications in this state. See Idaho Code 26-31-201
  • Magistrate judges: Judicial officers who assist U.S. district judges in getting cases ready for trial, who may decide some criminal and civil trials when both parties agree to have the case heard by a magistrate judge instead of a judge.

  • maliciously: means the intentional doing of a wrongful act without just cause or excuse, with an intent to inflict an injury or death. See Idaho Code 25-3502
  • manufacture: means to grind, mix or blend, or further process a commercial feed for distribution. See Idaho Code 25-2703
  • Manure: means animal excrement that may also contain bedding, spilled feed, water or soil. See Idaho Code 22-4904
  • manure: means manure, bedding, compost and raw materials or other materials commingled with manure or set aside for disposal. See Idaho Code 25-4002
  • Marital deduction: The deduction(s) that can be taken in the determination of gift and estate tax liabilities because of the existence of a marriage or marital relationship.
  • Material litigation: means any litigation that, according to generally accepted accounting principles, is deemed significant to the financial health of a business and would be required to be referenced in the business’s annual audited financial statements, report to shareholders or similar documents.   • Measurable student achievement: means the measurement of student academic achievement or growth within a given interval of instruction for those students who have been enrolled in and attended eighty percent (80%) of the interval of instruction. See Idaho Code 33-1001

  • Idaho Code 28-46-401
  • Payment instrument: means any check, draft, money order, traveler’s check or other instrument or written order for the transmission or payment of money, sold or issued to one (1) or more persons, whether or not such instrument is negotiable. See Idaho Code 26-2902
  • Per stirpes: The legal means by which the children of a decedent, upon the death of an ancestor at a level above that of the decedent, receive by right of representation the share of the ancestor
  • Performance certificate: means a fixed-term, renewable certificate between a public charter school and an authorized chartering entity that outlines the roles, powers, responsibilities and performance expectations for each party to the certificate. See Idaho Code 33-5202A
  • Performance criteria: means the standards specified for instructional staff and pupil service staff to demonstrate teaching proficiency for a given compensation rung. See Idaho Code 33-1001
  • Perishable agricultural food product: means an agricultural product as defined in section 22-2602, Idaho Code, intended for human consumption which is sold or distributed in a form that will perish or decay beyond marketability within a period of time. See Idaho Code 28-1-303
  • Perishable food: includes , but is not limited to, fresh or processed meats, poultry, seafood, dairy products, bakery products, eggs in the shell, fresh fruits or vegetables, foods that have been packaged, refrigerated or frozen and unserved food of any kind which has been prepared by or for a food establishment.   • Person: means an individual; corporation; business trust; estate; trust; partnership; limited liability company; association; joint venture; government; governmental subdivision, agency, or instrumentality; public corporation; or any other legal or commercial entity. See Idaho Code 30-14-102
  • Person: means any individual, association, partnership, firm, joint stock company, joint venture, trust, estate, private corporation, or any legal entity, which is recognized by law as the subject of rights and duties. See Idaho Code 25-3803
  • Person: means any individual, association, partnership, firm, joint stock company, joint venture, trust, estate, political subdivision, public or private corporation, state or federal governmental department, agency or instrumentality, or any legal entity, that is recognized by law as the subject of rights and duties.   • Person: means an individual, a trust, an estate, a partnership, an association, a foundation, a guardianship, a corporation, or a custodian under the Idaho uniform transfers to minors act. See Idaho Code 33-5401
  • Person: means any individual, estate, trust, receiver, cooperative association, club, corporation, company, firm, partnership, joint venture, syndicate, or other entity and, to the extent permitted by law, any federal, state or other governmental unit or subdivision or agency, department or instrumentality thereof.   • Personal representative: means the executor or administrator of the decedent or, if no executor or administrator is appointed, qualified and acting, any person who has possession of any property. See Idaho Code 28-45-104
  • Petition: means the document submitted by a person or persons to the authorized chartering entity to request the creation of a public charter school. See Idaho Code 33-5202A
  • Place of primary use: means the residential street address or the primary business street address in Idaho where the customer’s use of the wireless or VoIP service primarily occurs. See Idaho Code 31-4802
  • Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.
  • Postsecondary credit: means credit awarded to a student on his or her postsecondary transcript for the completion of a course. See Idaho Code 33-5102
  • Poultry: means chickens, turkeys, ducks, geese and any other bird raised in captivity. See Idaho Code 25-4002
  • Pound: means a place enclosed by public authority for the detention of stray animals. See Idaho Code 25-3502
  • Precinct: includes all election districts. See Idaho Code 34-2401
  • Predecessor act: means the act repealed by section 30-14-702, Idaho Code. See Idaho Code 30-14-102
  • Premises: means the building and contiguous property owned or leased or used under a government permit by a licensee, as part of the business establishment in the business of sale of liquor by the drink at retail, which property is improved to include decks, docks, boardwalks, lawns, gardens, golf courses, ski resorts, courtyards, patios, poolside areas or similar improved appurtenances in which the sale of liquor by the drink at retail is authorized under the provisions of law.   • premises: means the building and contiguous property owned, or leased or used under government permit by a licensee as part of the business establishment in the business of sale of beer at retail, which property is improved to include decks, docks, boardwalks, lawns, gardens, golf courses, ski resorts, courtyards, patios, poolside areas or similar improved appurtenances in which the sale of beer at retail is authorized under the provisions of law. See Idaho Code 23-1001
  • present sale: means a sale which is accomplished by the making of the contract. See Idaho Code 28-2-106
  • President pro tempore: A constitutionally recognized officer of the Senate who presides over the chamber in the absence of the Vice President. The President Pro Tempore (or, "president for a time") is elected by the Senate and is, by custom, the Senator of the majority party with the longest record of continuous service.
  • Presiding officer: A majority-party Senator who presides over the Senate and is charged with maintaining order and decorum, recognizing Members to speak, and interpreting the Senate's rules, practices and precedents.
  • Price amendment: means the amendment to a registration statement filed under the securities act of 1933 or, if an amendment is not filed, the prospectus or prospectus supplement filed under the securities act of 1933 that includes a statement of the offering price, underwriting and selling discounts or commissions, amount of proceeds, conversion rates, call prices, and other matters dependent upon the offering price.   • Probable cause: A reasonable ground for belief that the offender violated a specific law.
  • Probation officers: Screen applicants for pretrial release and monitor convicted offenders released under court supervision.
  • Process: as used in this chapter includes all writs, warrants, summons and orders of courts of justice or judicial officers. See Idaho Code 31-2201
  • Process wastewater: means liquid containing beef cattle manure, process-generated wastewater and any precipitation which comes into direct contact with livestock manure and facility products or byproducts. See Idaho Code 22-4904
  • Process wastewater: means water directly or indirectly used in the operation of the AFO for any or all of the following: spillage or overflow from animal or poultry watering systems; washing, cleaning or flushing pens, barns, manure pits or other AFO facilities; direct contact swimming, washing or spray cooling of animals; or dust control. See Idaho Code 25-4002
  • Produce safety rule: means the standards for growing, harvesting, packing and holding of produce for human consumption promulgated pursuant to the food and drug administration food, drug and cosmetic act. See Idaho Code 22-5403
  • Producer: means the owner, tenant or operator of land in this state who has an interest in the proceeds from the sale of seed crops grown on that same land. See Idaho Code 22-5102
  • Producer: means a person who produces milk from cows and sells it for human or animal food, or medicinal or industrial uses;

  • Producer-handler: means any person who produces milk or milk fat and uses such production, or any part of it, for processing. See Idaho Code 25-3103
  • product name: means the name of the commercial feed which identifies it as to kind, class or specific use. See Idaho Code 25-2703

  • Proof of death: includes a death certificate or record or report which is prima facie proof of death under section 15-1-107 of this code;

  • Property: means property included in the gross estate. See Idaho Code 28-45-104
  • Provider: means the promoter, developer, or owner of a continuing care facility, whether a natural person, partnership, unincorporated association, trust, or corporation, or any other person, or that person’s successors or assigns that solicits or undertakes to provide continuing care to the public under a continuing care facility contract. See Idaho Code 26-3703
  • Provider: means any person, firm or corporation certified or licensed by the state of Idaho or holding an equivalent license or certification in another state, that provides necessary medical services to a patient requesting a medically indigent status determination or filing an application for financial assistance. See Idaho Code 31-3502
  • Public charter school: means a school that is authorized under this chapter to deliver public education in Idaho. See Idaho Code 33-5202A
  • Public defender: Represent defendants who can't afford an attorney in criminal matters.
  • Public law: A public bill or joint resolution that has passed both chambers and been enacted into law. Public laws have general applicability nationwide.
  • Public library service: means the provision of planned collections of materials and information services provided by a library established under the provisions of chapter 26 or 27, title 33, Idaho Code, and paid for primarily through tax support provided under these statutes. See Idaho Code 33-2702
  • Public safety communications and data systems: refers to the general systematic ability of people or entities to communicate or manage data with other people or entities using technology for the purpose of reporting and responding to situations that require a public safety response. See Idaho Code 31-4802
  • Public safety communications stakeholders: means any city, county, fire district, ambulance district, and the state. See Idaho Code 31-4802
  • Pupil service staff: means those who provide services to students but are not involved in direct instruction of those students, and hold a pupil personnel services certificate. See Idaho Code 33-1001
  • pupils in average daily attendance: means the aggregate number of days enrolled students are present, divided by the number of days of school in the reporting period; provided, however, that students for whom no Idaho school district is a home district shall not be considered in such computation. See Idaho Code 33-1001
  • purchase: includes taking by sale, discount, negotiation, mortgage, pledge, lien, issue or reissue, gift or any other voluntary transaction creating an interest in property. See Idaho Code 25-2703
  • purchaser: means a person who takes by purchase. See Idaho Code 25-2703
  • Qualified elector: means any person voting, or offering to vote, at an election to create a library district, add territory thereto, or elect trustees thereof. See Idaho Code 33-2702
  • Qualified facility: means a hotel, inn or motel which is licensed to sell alcoholic beverages for on-premises consumption and which contains guest room accommodations. See Idaho Code 23-1401
  • Qualified registered guest: means each person of legal drinking age who signs the guest register of a qualified facility or takes some other equivalent action for the purpose of registering as a guest of such qualified facility. See Idaho Code 23-1401
  • Qualified withdrawal: means a withdrawal from an account to pay the qualified higher education expenses of the designated beneficiary of the account, but only if the withdrawal is made in accordance with this chapter. See Idaho Code 33-5401
  • Quorum: The number of legislators that must be present to do business.
  • range: means an area designed and operated for the use of rifles, shotguns, pistols, silhouettes, skeet, trap, black powder, archery or any other similar sport shooting;

  • Receipt: means a warehouse receipt. See Idaho Code 22-5102
  • Recess: A temporary interruption of the legislative business.
  • Recipient: means the individual(s) determined eligible for county assistance. See Idaho Code 31-3403
  • Recipient: means an individual determined eligible for financial assistance under this chapter. See Idaho Code 31-3502
  • Record: means information that is inscribed on a tangible medium or that is stored in an electronic or other medium and is retrievable in perceivable form. See Idaho Code 28-7-102
  • Recourse: An arrangement in which a bank retains, in form or in substance, any credit risk directly or indirectly associated with an asset it has sold (in accordance with generally accepted accounting principles) that exceeds a pro rata share of the bank's claim on the asset. If a bank has no claim on an asset it has sold, then the retention of any credit risk is recourse. Source: FDIC
  • Registered mail: includes certified mail. See Idaho Code 73-114
  • registrant: means that person, manufacturer, guarantor, or distributor who registers a product or products according to the provisions of section 25-2704, Idaho Code. See Idaho Code 25-2703
  • Reimbursement rate: means the unadjusted medicaid rate of reimbursement for medical charges allowed pursuant to title XIX of the social security act, as amended, that is in effect at the time service is rendered. See Idaho Code 31-3502
  • Release: means a release of no tax due or a receipt for payment of the tax due under this chapter. See Idaho Code 28-45-104
  • Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
  • Remand: When an appellate court sends a case back to a lower court for further proceedings.
  • Repayment: means the authority of the board of county commissioners to require indigent person(s) to repay the county for assistance when investigation of their application determines their ability to do so. See Idaho Code 31-3403
  • Reporter: Makes a record of court proceedings and prepares a transcript, and also publishes the court's opinions or decisions (in the courts of appeals).
  • Representative of a licensee: means any full-time employee, agent or other person who buys, receives, sells, or assembles livestock for resale on behalf of a licensed livestock dealer. See Idaho Code 25-3301
  • Request: means a proper request for withdrawal, or a check or order for payment, which complies with all conditions of the account, including special requirements concerning necessary signatures and regulations of the financial institutions; but if the financial institution conditions withdrawal or payment on advance notice, for purposes of this part the request for withdrawal or payment is treated as immediately effective and a notice of intent to withdraw is treated as a request for withdrawal;

  • Residence: means a single-family house, duplex, triplex, quadraplex, condominium or a unit in a multiunit residential structure in which title to each individual unit is transferred to the owner under a cooperative system. See Idaho Code 28-2-311
  • Resident: means an individual entitled to receive continuing care in a facility. See Idaho Code 26-3703
  • Resident: means a person with a home, house, place of abode, place of habitation, dwelling or place where he or she actually lived for a consecutive period of thirty (30) days or more within the state of Idaho. See Idaho Code 31-3502
  • Resident: means a decedent who was domiciled in Idaho at the time of death. See Idaho Code 28-45-104
  • Resident student: means an individual as defined in section 33-3717B, Idaho Code. See Idaho Code 33-4403
  • Residential property: means any building or structure to be primarily occupied by people, either as a dwelling or as a business, including a storage facility, mobile home, manufactured home or recreational vehicle that may be sold, leased or rented for any length of time.   • Residential property owner: means the person holding record title to residential property, as defined in this section. See Idaho Code 28-2-316
  • Resources: means all property, for which an applicant and/or an obligated person may be eligible or in which he or she may have an interest, whether tangible or intangible, real or personal, liquid or nonliquid, or pending, including, but not limited to, all forms of public assistance, crime victims compensation, worker’s compensation, veterans benefits, medicaid, medicare, supplemental security income (SSI), third party insurance, other insurance or apply for section 1011 of the medicare modernization act of 2003, if applicable, and any other property from any source. See Idaho Code 31-3502
  • Retail wine license: means a license issued by the director, authorizing a person to sell table wine and/or dessert wine at retail for consumption off the licensed premises. See Idaho Code 23-1303
  • retailer: means a person licensed to sell beer to consumers at premises described in the license. See Idaho Code 23-1001
  • Retailer: means a person to whom a retail wine license has been issued. See Idaho Code 23-1303
  • Retaliatory action: includes the refusal to continue an agreement, or a material part thereof, or a material reduction in the quality of service or quantity of products available to a distributor under an agreement, which refusal or reduction is not made in good faith. See Idaho Code 23-1102
  • Right of rescission: Right to cancel, within three business days, a contract that uses the home of a person as collateral, except in the case of a first mortgage loan.   • Secondary credit: means credit awarded to a student on his or her secondary transcript for the completion of a course. See Idaho Code 33-5102
  • Securities and exchange commission: means the United States securities and exchange commission. See Idaho Code 30-14-102
  • Security: means a note; stock; treasury stock; security future; bond; debenture; evidence of indebtedness; certificate of interest or participation in a profit-sharing agreement; collateral trust certificate; preorganization certificate or subscription; transferable share; investment contract; voting trust certificate; certificate of deposit for a security; fractional undivided interest in oil, gas or other mineral rights; put, call, straddle, option or privilege on a security, certificate of deposit, or group or index of securities, including an interest therein or based on the value thereof; put, call, straddle, option, or privilege entered into on a national securities exchange relating to foreign currency; or, in general, an interest or instrument commonly known as a "security"; or a certificate of interest or participation in, temporary or interim certificate for, receipt for, guarantee of, or warrant or right to subscribe to or purchase, any of the foregoing.   • Seed buyer: means any person having a commercial operation, its agents and employees, together with its elevators, mills, buildings, or other structures who owes or has any financial obligation to the producer for seed crop grown by that producer and transferred to the seed buyer. See Idaho Code 22-5102
  • Seed crops: means any seed crop regulated by chapter 4, title 22, Idaho Code. See Idaho Code 22-5102
  • Seed facility: means :

  • Self-regulatory organization: means a national securities exchange registered under the securities exchange act of 1934, a national securities association of broker-dealers registered under the securities exchange act of 1934, a clearing agency registered under the securities exchange act of 1934, or the municipal securities rulemaking board established under the securities exchange act of 1934.   • Seller: means a person who sells or contracts to sell goods. See Idaho Code 28-2-103
  • Separate elementary school: means an elementary school located more than ten (10) miles on an all-weather road from both the nearest elementary school and elementary/secondary school serving like grades within the same school district and from the location of the office of the superintendent of schools of such district, or from the office of the chief administrative officer of such district if the district employs no superintendent of schools. See Idaho Code 33-1001
  • Separate secondary school: means any secondary school located more than fifteen (15) miles on an all-weather road from any other secondary school and elementary/secondary school serving like grades operated by the district. See Idaho Code 33-1001
  • service: means personal service or delivery by certified mail to the last known address of the addressee. See Idaho Code 28-2-311
  • Shipper: means a person that enters into a contract of transportation with a carrier. See Idaho Code 28-7-102
  • Sole ownership: The type of property ownership in which one individual holds legal title to the property and has full control of it.
  • Solid waste: means any garbage, refuse, sludge from a waste treatment plant, water supply treatment plant, or air pollution control facility and other discarded material, including solid, liquid, semi-solid, or contained gaseous material resulting from industrial, commercial, mining, and agricultural operations, and from community activities, but does not include solid or dissolved materials in domestic sewage, or solid or dissolved materials in irrigation return flows or industrial discharges that are point sources subject to permits under 33 U. See Idaho Code 31-4902
  • Sport shooting activities: means the use of firearms, airguns and archery equipment for target practice, competition, training, instruction or other similar activities;

  • Sport shooting instructor: means a person who holds a current instructor certification issued by the Idaho department of fish and game, the Idaho state police, the national rifle association or other nationally recognized organization, which certifies shooting instructors who are engaged, whether or not for compensation, in instructing, training or coaching a participant in sport shooting activities;

  • Sport shooting range operator: means an individual, group or club, partnership, limited liability company or corporation, whether or not operating for profit, which owns, operates or otherwise provides a range for sport shooting activities; and

  • State: means any state, district, commonwealth, territory, insular possession, or any other area subject to the legislative authority of the United States. See Idaho Code 28-46-101
  • State: means the state of Idaho. See Idaho Code 26-2902
  • State: means the state of Idaho. See Idaho Code 31-4902
  • State: means a state of the United States, the District of Columbia, Puerto Rico, the United States Virgin Islands, or any territory or insular possession subject to the jurisdiction of the United States. See Idaho Code 30-14-102
  • State agency: includes every constitutional and statutory office, officer, department, division, bureau, board, commission and agency of the state and, where applicable, all subdivisions of each. See Idaho Code 33-2505A
  • State board: means the Idaho state board of education. See Idaho Code 33-3402
  • State board: means the Idaho state board of education. See Idaho Code 33-5505
  • State liquor store: means a liquor store or distributor established under and pursuant to the laws of the state of Idaho for the package sale of liquor at retail. See Idaho Code 23-902
  • State publication: means any information, regardless of format, published by a state agency and intended for distribution to the public. See Idaho Code 33-2505A
  • Stock grower: means any person owning any livestock in this state to be slaughtered for human consumption whether in this state or outside of this state, or any person engaging in the business of breeding, growing or raising livestock. See Idaho Code 25-1101
  • Stored for withdrawal: means the deposit of seed crop with a seed facility by the producer for the subsequent withdrawal by that producer of the same seed crop or similar seed crop, as agreed to by the parties. See Idaho Code 22-5102
  • Student: means an individual who is deaf or hard of hearing and/or blind or visually impaired and who qualifies for educational services as provided for in this chapter pursuant to eligibility criteria set forth in the Idaho standards for infants, toddlers, children, and youth who are deaf or hard of hearing as incorporated by reference in IDAPA 08. See Idaho Code 33-3402
  • Student: means an individual currently at an Idaho school enrolled in a postsecondary degree program, or a state supported professional-technical program. See Idaho Code 33-4403
  • Student success indicators: means measurable indicators of student achievement or growth, other than academic, within a predefined interval of time for a specified group of students. See Idaho Code 33-1001
  • Subpoena duces tecum: A command to a witness to produce documents.
  • Sums on deposit: means the balance payable on a multiple-party account including interest, dividends, and in addition any deposit life insurance proceeds added to the account by reason of the death of a party;

Supplemental appropriations generally are made to cover emergencies, such as disaster relief, or other needs deemed too urgent to be postponed until the enactment of next year's regular appropriations act.
  • Supplemental services: means services provided to deaf or hard of hearing and/or blind or visually impaired students and their families, in addition to and in support of services the student may receive from his or her school district. See Idaho Code 33-3402

  • System: means all components of solid waste operations including, but not limited to, landfill compliance measures, landfill disposal operations, regional transfer operations, domestic septage receiving stations, domestic septage disposal methods, domestic septage treatment operations and resource recovery and management, on any site or sites acquired, constructed, operated, or managed by a district.   • Table wine: shall mean any alcoholic beverage containing not more than sixteen percent (16%) alcohol by volume obtained by the fermentation of the natural sugar content of fruits or other agricultural products containing sugar whether or not other ingredients are added. See Idaho Code 23-1303
  • Taxable estate: means "taxable estate" as defined in section 2051 of the United States Internal Revenue Code of 1986. See Idaho Code 28-45-104
  • Teacher: means any person employed in a teaching, instructional, supervisory, educational administrative or educational and scientific capacity in any school district. See Idaho Code 33-1001
  • Technology: means all present and future forms of computer hardware, computer software and services used or required for automated data processing, computer-related office automation or telecommunications. See Idaho Code 33-4803

  • Temporary restraining order: Prohibits a person from an action that is likely to cause irreparable harm. This differs from an injunction in that it may be granted immediately, without notice to the opposing party, and without a hearing. It is intended to last only until a hearing can be held.

  • Title loan agreement: means a written agreement whereby a title lender agrees to make a title loan to a debtor, and the debtor agrees to give the title lender a security interest in unencumbered titled personal property owned by the debtor. See Idaho Code 28-46-502
  • Titled personal property: means any motor vehicle, the ownership of which is evidenced and delineated by a state issued certificate of title, but does not include a motor home, mobile home or manufactured home. See Idaho Code 28-46-502
  • Traditional public school: means any school existing or to be built that is operated and controlled by a school district in this state. See Idaho Code 33-5202A
  • Transfer: means , unless otherwise defined by the parties in writing, the event when a producer or his agent delivers seed crop to the seed buyer who then gives the producer or his agent a scale weight ticket, receipt, or other written evidence of transfer. See Idaho Code 22-5102
  • Transfer: means "transfer" as defined and used in section 2001 of the United States Internal Revenue Code of 1986. See Idaho Code 28-45-104
  • Transportation: means the movement of livestock in any manner. See Idaho Code 25-1101
  • Trial jury: A group of citizens who hear the evidence presented by both sides at trial and determine the facts in dispute. Federal criminal juries consist of 12 persons. Federal civil juries consist of six persons.
  • Trust account: means an account in the name of one (1) or more parties as trustee for one (1) or more beneficiaries where the relationship is established by the form of the account and the deposit agreement with the financial institution and there is no subject of the trust other than the sums on deposit in the account; it is not essential that payment to the beneficiary be mentioned in the deposit agreement.   • Trustor: The person who makes or creates a trust. Also known as the grantor or settlor.
  • Unauthorized discharge: means a discharge of process wastewater or livestock manure to state surface waters that does not meet the requirements of this chapter or water quality standards. See Idaho Code 22-4904

  • Unique identifier: means a number or other identifier assigned by protocols established by the NMLSR. See Idaho Code 26-31-102
  • University debit card: means a card issued by a college or university located in this state to a registered student or a member of its faculty or staff which permits such persons to draw against funds on deposit with the college or university business office for the purchase of goods or services.   • University debit card program: means a financial arrangement whereby a college or university allows a registered student or a member of its faculty or staff to place funds on deposit with the college or university business office against which such persons may draw, through a debit card transaction, for the purchase of either goods or services or both.   • User fees: Fees charged to users of goods or services provided by the government. In levying or authorizing these fees, the legislature determines whether the revenue should go into the treasury or should be available to the agency providing the goods or services.

  • Utility: means a person who owns or operates for public use any plant, equipment, property, franchise, or license for the transmission of communications or the production, storage, transmission, sale, delivery, or furnishing of electricity, water, steam, or gas. See Idaho Code 28-46-101
  • Utilization management: means the evaluation of medical necessity, appropriateness and efficiency of the use of health care services, procedures and facilities. See Idaho Code 31-3502
  • Variable Rate: Having a "variable" rate means that the APR changes from time to time based on fluctuations in an external rate, normally the Prime Rate. This external rate is known as the "index." If the index changes, the variable rate normally changes. Also see Fixed Rate.

  • Veto: The procedure established under the Constitution by which the President/Governor refuses to approve a bill or joint resolution and thus prevents its enactment into law. A regular veto occurs when the President/Governor returns the legislation to the house in which it originated.
