  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.

     In the event any proceeding is commenced against any State employee alleging deprivation of a civil or constitutional right under State or federal law arising out of any act or omission occurring within the scope of the enforcement of this Act, the Attorney General shall upon timely and appropriate notice in accordance with “An Act to provide for representation and indemnification in certain civil law suits”, approved December 3, 1977, as now or hereafter amended, appear on behalf of such employee and defend the action. The State shall indemnify the State employee for any damages awarded and court costs and attorneys’ fees assessed as part of any final and unreversed judgment or shall pay such judgment. All other provisions of “An Act to provide for representation and indemnification in certain civil law suits”, approved December 3, 1977, as now or hereafter amended, shall apply to the representation and indemnification provided for in this Section.
