Sec. 50. (a) Except as provided in subsection (b), a person may not act as a licensed applicator not for hire unless the person has obtained a license from the state chemist.

Terms Used In Indiana Code 15-16-5-50

  • direct supervision: refers to the supervision required under Indiana Code 15-16-5-10.5
  • licensed applicator not for hire: means a licensed certified commercial applicator who is employed by a private employer to use or supervise the use of a restricted use pesticide only on the property of the employer. See Indiana Code 15-16-5-17
  • person: means any individual, partnership, association, fiduciary, corporation, or any organized group of persons whether incorporated or not. See Indiana Code 15-16-5-23
  • pesticide: means :

  • use: means an act of handling, releasing, or exposing individuals or the environment to a pesticide. See Indiana Code 15-16-5-36
     (b) A person who is not a licensed applicator not for hire may use a restricted use pesticide if the person is under the direct supervision of a licensed applicator not for hire.
