Sec. 11.5. (a) For purposes of an administrative proceeding regarding an action taken by the department, the director or the director’s designee is the ultimate authority of the department.
(1) a deputy director of the department; or
(b) A designee of the director under subsection (a) must be:

- Attorney: includes a counselor or other person authorized to appear and represent a party in an action or special proceeding. See Indiana Code 1-1-4-5
- department: refers to the department of child services established by IC 31-25-1-1. See Indiana Code 31-25-2-1
(2) an individual who:
(A) is an attorney in good standing who is admitted to the practice of law in Indiana; and
(B) is an employee of the department, except as otherwise allowed under state and federal law.
