Sec. 33. (a) A master may issue a subpoena for:
(2) the production of documentary evidence; or
(1) the attendance of witnesses;
Terms Used In Indiana Code 33-38-14-33
- commission: means the commission on judicial qualifications described in Article 7, Section 9 of the Constitution of the State of Indiana. See Indiana Code 33-38-14-2
- Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.
- Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
- masters: means the special masters appointed by the chief justice upon request of the commission. See Indiana Code 33-38-14-6
- Subpoena: A command to a witness to appear and give testimony.
(3) discovery;
in a proceeding before the masters. The master shall serve the subpoena in the manner provided by law.
(b) The chairman of the commission may issue a subpoena for:
(1) the attendance of witnesses;
(2) the production of documentary evidence; or
(3) discovery;
in a proceeding before the commission or in which masters have not been appointed. The chairman shall serve the subpoena in the manner provided by law.
