Terms Used In Indiana Code 5-2-18.2-5

  • Attorney: includes a counselor or other person authorized to appear and represent a party in an action or special proceeding. See Indiana Code 1-1-4-5
  • governmental body: has the meaning set forth in IC 5-22-2-13. See Indiana Code 5-2-18.2-1
  • postsecondary educational institution: refers to any state educational institution (as defined in IC 21-7-13-32) or private postsecondary educational institution that receives state or federal funds. See Indiana Code 5-2-18.2-2.2
  • Probable cause: A reasonable ground for belief that the offender violated a specific law.
   Sec. 5. If the attorney general determines that probable cause exists that a governmental body or a postsecondary educational institution has violated this chapter, the attorney general shall bring an action to compel the governmental body or postsecondary educational institution to comply with this chapter.
